1 A BILL for an Act to create and enact a new section to chapter 16.1-08.1 of the North Dakota
2 Century Code, relating to reports of expenditures made in support of or opposition to legislative
3 candidates; to amend and reenact subsection 7 of section 16.1-08.1-01; and to provide a
4 penalty.
5 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
6 SECTION 1. AMENDMENT. Subsection 7 of section 16.1-08.1-01 of the North Dakota
7 Century Code is amended and reenacted as follows:
8 7. "Expenditure categories" means the categories into which expenditures must be
9 grouped for reports under this chapter. The expenditure categories are:
10 a. Advertising by:
11 (1) Radio;
12 (2) Mail;
13 (3) Television;
14 (4) Printed media; and
15 (5) Social media;
16 b. Campaign loan repayment;
17 c. Operations;
18 d. Travel; and
19 e. Miscellaneous.
20 SECTION 2. A new section to chapter 16.1-08.1 of the North Dakota Century Code is
21 created and enacted as follows:

1 Expenditure reports by multicandidate political committees.
2 1. A multicandidate political committee required to file a report under section
3 16.1-08.1-02.3 shall file expenditure reports under this section with the secretary of
4 state. For each aggregated expenditure of five thousand dollars or more spent in
5 support of or opposition to a member of the legislative assembly or a candidate for the
6 office of state senator or state representative, the multicandidate political committee
7 shall file a report including:
8 a. The aggregated amount expended;
9 b. The name of the member or candidate supported or opposed;
10 c. Whether the expenditure was made in support of or opposition to the member or
11 candidate;
12 d. The date of the expenditure; and
13 e. A general description of the items, services, or contributions for which the
14 expenditure was made, including the applicable expenditure category.
15 2. For purposes of calculating the aggregated expenditure per member of the legislative
16 assembly or candidate for the office of state senator or state representative under
17 subsection 1, expenditures made in support of or opposition to multiple members or
18 candidates must be divided equally by the number of members or candidates
19 supported or opposed, and the resulting amount must be allocated to each of the
20 relevant members or candidates. The statement must delineate clearly the amount
21 expended in support of or opposition to each candidate.
22 3. Reports under this section must be filed within forty-eight hours after the
23 multicandidate political committee makes the expenditure that, when aggregated with
24 other expenditures in support of or opposition to the member or candidate, exceeds
25 five thousand dollars.
