1 A BILL for an Act to authorize the department of corrections and rehabilitation to convey real
2 property owned by the state of North Dakota; to authorize the department of corrections and
3 rehabilitation to acquire certain real property in Burleigh or Morton Counties; and to provide a
4 continuing appropriation.
5 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
6 SECTION 1. CONVEYANCE OF LAND AUTHORIZED - ACQUISITION OF LAND
7 AUTHORIZED - CONTINUING APPROPRIATION.
8 1. Except as otherwise provided in subsection 3, the state of North Dakota, by and
9 through the department of corrections and rehabilitation, shall convey all real property
10 used for the purposes of the Missouri River correctional center in Burleigh County and
11 all state property under the control of the department of corrections and rehabilitation
12 in Morton County for fair market value and on the terms as determined by the
13 department of corrections and rehabilitation. Sections 54-01-05.2 and 54-01-05.5 do
14 not apply to a conveyance authorized by this subsection.
15 2. The state of North Dakota, by and through the department of corrections and
16 rehabilitation, shall locate certain real property owned by the state in Burleigh County
17 to be used for the purposes of constructing new facilities to replace the Missouri River
18 correctional facility and the youth correctional facility.
19 3. The department of corrections and rehabilitation shall maintain possession of the real
20 property where the Missouri River correction center and the youth correctional center
21 are located until the new facilities have been constructed.
22 4. The department of corrections and rehabilitation shall consider using low-cost steel to
23 construct the new facilities.

1 5. The department of corrections and rehabilitation shall use any funds received under
2 the conveyance of state land under subsection 1 for the construction of new facilities.
3 Any funds received as a result of a conveyance under subsection 1 which exceed the
4 amount necessary to construct new facilities must be deposited in a special fund that
5 may be used by the department of corrections and rehabilitation for building
6 maintenance and those funds are appropriated on a continuing basis for that purpose.
