1 A BILL for an Act to amend and reenact subsection 1 of section 16.1-08.1-03.2, subsection 1 of
2 section 16.1-11-06, section 16.1-11-09, subsection 1 of section 16.1-11-11, and subsection 1 of
3 section 16.1-11-16 of the North Dakota Century Code, relating to a candidate's contact
4 information and the form of a nominating petition and a certificate of endorsement.
5 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
6 SECTION 1. AMENDMENT. Subsection 1 of section 16.1-08.1-03.2 of the North Dakota
7 Century Code is amended and reenacted as follows:
8 1. A political committee as defined in section 16.1-08.1-01 shall register its name and
9 contact information, mailing address, telephone number, and nongovernment issued
10 electronic mail address, its agent's name and contact information, mailing address,
11 telephone number, and nongovernment issued electronic mail address, and a
12 designation as to whether the committee is incorporated solely for the purpose of
13 liability protection, with the secretary of state. A candidate who does not have a
14 candidate committee shall register the candidate's name and contact information and,
15 if, mailing address, telephone number, and nongovernment issued electronic mail
16 address with the secretary of state. If the candidate has an agent, the candidate also
17 shall register the agent's name and contact information, mailing address, telephone
18 number, and nongovernment issued electronic mail address with the secretary of
19 state. The registration required under this section for a candidate or political committee
20 that has not previously registered with the secretary of state must be submitted within
21 fifteen business days of the receipt of any contribution or expenditure made.
22 SECTION 2. AMENDMENT. Subsection 1 of section 16.1-11-06 of the North Dakota
23 Century Code is amended and reenacted as follows:

1 1. Every candidate for United States senator, United States representative, a state office,
2 including the office of state senator or state representative, and judges of the supreme
3 and district courts shall present to the secretary of state, between the first date
4 candidates may begin circulating nominating petitions according to this chapter and
5 before four p.m. of the sixty-fourth day before any primary election, either:
6 a. The certificate of endorsement signed by the state or district chairman of any
7 legally recognized political party containing the candidate's name, post-office
8 address, nongovernment issued electronic mail address, and telephone number,
9 the title of the office to which the candidate aspires, and the party which the
10 candidate represents; or
11 b. The nominating petition containing the following:
12 (1) The candidate's name, post-office address, nongovernment issued
13 electronic mail address, and telephone number, and the title of the office to
14 which the candidate aspires, the appropriate district judgeship number if
15 applicable, and whether the petition is intended for nomination for an
16 unexpired term of office if applicable.
17 (2) The name of the party the candidate represents if the petition is for an office
18 under party designation.
19 (3) The signatures and printed names of qualified electors, the number of which
20 must be determined as follows:
21 (a) If the office is under party designation, the signatures of three percent
22 of the total vote cast for the candidates of the party with which the
23 candidate affiliates for the same position at the last general election.
24 However, no more than three hundred signatures may be required.
25 (b) If there was no candidate of a party for a position at the preceding
26 general election, at least three hundred signatures.
27 (c) If the office is under the no-party designation, at least three hundred
28 signatures.
29 (d) If the office is a legislative office, the signatures of at least one percent
30 of the total resident population of the legislative district as determined
31 by the most recent federal decennial census.

1 (4) The mailing address and the date of signing for each signer.
2 SECTION 3. AMENDMENT. Section 16.1-11-09 of the North Dakota Century Code is
3 amended and reenacted as follows:
4 16.1-11-09. Form of certificate of endorsement.
5 A certificate of endorsement filed with the proper officer as provided in this chapter must be
6 in substantially the following form:
7 CERTIFICATE OF ENDORSEMENT
8 I, ______________, do certify that I am the state (district) chairman of the
9 ______________ political party of the ______________ legislative district (if appropriate) of
10 the state of North Dakota and that ______________ (insert name of endorsee), residing at
11 ____________, whose nongovernment issued electronic mail address is ______________,
12 was duly endorsed for nomination to the office of ______________ on the
13 ______________ day of __________, by the ______________ political party of the
14 ______________ legislative district (if appropriate), duly convened and organized in
15 accordance with the bylaws of the ______________ political party and the laws of this
16 state, and do hereby request ______________ name be printed upon the ballot as a
17 candidate for nomination to the office of ______________ at the forthcoming primary
18 election to be held on ______________ of this year.

22 SECTION 4. AMENDMENT. Subsection 1 of section 16.1-11-11 of the North Dakota
23 Century Code is amended and reenacted as follows:
24 1. The candidate's name, post-office address, nongovernment issued electronic mail
25 address, and telephone number, the title of the office to which the candidate aspires,
26 the appropriate district number if applicable, and whether the petition is intended for
27 nomination for an unexpired term of office if applicable.
28 SECTION 5. AMENDMENT. Subsection 1 of section 16.1-11-16 of the North Dakota
29 Century Code is amended and reenacted as follows:

1 1. Each nominating petition circulated by candidates for any state, district, county, or
2 other political subdivision office must include or have attached the following
3 information, which must be made available to each signer at the time of signing:
4 a. The candidate's name, address, nongovernment issued electronic mail address,
5 and telephone number and the title of the office to which the candidate aspires,
6 including the appropriate district number if applicable, and whether the petition is
7 intended for a full or unexpired term of office.
8 b. The name of the party the candidate represents if the petition is for an office
9 under party designation.
10 c. The date of the election at which the candidate is seeking nomination or election.
