1 A BILL for an Act to create and enact a new section to chapter 50-06 of the North Dakota
2 Century Code, relating to the mental health and well-being advisory committee; to provide for a
3 legislative management report; and to provide an appropriation.
4 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
5 SECTION 1. A new section to chapter 50-06 of the North Dakota Century Code is created
6 and enacted as follows:
7 Mental health and well-being advisory committee - Membership - Duties - Report to
8 legislative management.
9 1. The mental health and well-being advisory committee is created to direct the use of
10 funding to address mental health and substance use disorder issues.
11 2. The mental health and well-being advisory committee consists of:
12 a. A member of the senate and a member of the house of representatives appointed
13 by the chairman of the legislative management;
14 b. Two members of local public health units appointed by the state health officer;
15 c. Two members representing behavioral health services appointed by the director
16 of the behavioral health division of the department of health and human services;
17 d. The dean of the university of North Dakota school of medicine and health
18 sciences, or a designee;
19 e. Two members representing elementary and secondary education appointed by
20 the superintendent of public instruction; and
21 f. The executive director of the department of health and human services, or a
22 designee.
23 3. The mental health and well-being advisory committee shall focus efforts to:

1 a. Develop approaches to individual and community-based prevention in the areas
2 of physical activity, diet, and sleep to address causes of mental health conditions;
3 b. Develop education and programming that informs children and parents of the
4 dangers of technology overuse;
5 c. Develop approaches to assist community members to identify mental health
6 conditions and provide interventions;
7 d. Design effective approaches to long-term treatment and recovery of mental
8 health conditions;
9 e. Improve access to effective programs and services to support mental health and
10 substance abuse recovery; and
11 f. Develop short and long-term approaches to improve mental health care
12 workforce recruitment and retention.
13 4. The department of health and human services shall provide staff services to the
14 committee.
15 5. The mental health and well-being advisory committee shall report quarterly to the
16 legislative management regarding the activities and recommendations of the
17 committee, including efforts in the areas of prevention, healthy technology use, early
18 intervention, treatment and recovery, and workforce development.
19 SECTION 2. APPROPRIATION - DEPARTMENT OF HEALTH AND HUMAN SERVICES -
20 MENTAL HEALTH AND WELL-BEING - ONE-TIME FUNDING. There is appropriated out of
21 any moneys in the general fund in the state treasury, not otherwise appropriated, the sum of
22 $50,000,000, or so much of the sum as may be necessary, to the department of health and
23 human services for the purpose of providing grants and implementing programming to address
24 mental health and well-being issues as recommended by the mental health and well-being
25 advisory committee, for the biennium beginning July 1, 2023, and ending June 30, 2025. A grant
26 recipient must provide ten percent matching funds for any funding received under this section.
27 The funding provided in this section is a one-time funding item.
