1 A BILL for an Act to provide an appropriation to the judicial branch and adjutant general; and to
2 provide a bond issue limit.
3 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
4 SECTION 1. PUBLIC FINANCE AUTHORITY - BOND ISSUE LIMITATION -
5 APPROPRIATION - JUDICIAL BRANCH - ADJUTANT GENERAL.
6 1. Pursuant to the bonding authority under section 6-09.4-06, the public finance authority
7 only may issue bonds under this Act to provide up to $126,000,000 of funds for
8 allocations to infrastructure projects and programs, for the biennium beginning July 1,
9 2023, and ending June 30, 2025.
10 2. The term of any bonds issued under this section may not exceed twenty years. The
11 public finance authority may issue bond anticipation notes or borrow from the Bank of
12 North Dakota to support the allocations to infrastructure projects and programs prior to
13 a bond issue. The state investment board may purchase the bonds as investments for
14 the funds under its management.
15 3. After payment of any issuance costs, capitalized interest, or any transfers to a reserve
16 fund, $126,000,000 from the bond proceeds issued by the public finance authority is
17 allocated and appropriated for infrastructure projects and programs, for the biennium
18 beginning July 1, 2023, and ending June 30, 2025, as follows:
19 a. $55,000,000 to the office of management and budget for the purpose of
20 renovating and constructing an addition to the liberty memorial building on the
21 grounds of the state capitol to serve as a new supreme court building.
22 (1) The office of management and budget shall procure architect and
23 engineering professional services pursuant to chapter 54-44.7 for the design
24 of the supreme court building.

1 (2) A supreme court building oversight committee shall require the person
2 contracted pursuant to subsection 2 to provide at least three preliminary
3 designs to be presented at a public meeting of the capitol grounds planning
4 commission pursuant to chapter 48-10.
5 (3) The oversight committee consists of the chief justice of the supreme court,
6 one member of the house of representatives appointed by the majority
7 leader of the house of representatives, one member of the senate appointed
8 by the majority leader of the senate, one individual appointed by the
9 governor, and two individuals appointed by the chief justice of the supreme
10 court. The judicial branch shall provide necessary administrative and
11 support services for the committee.
12 (4) Construction of the supreme court building may not begin until the oversight
13 committee approves a design by a majority vote.
14 (5) The chief justice of the supreme court must approve the design of the
15 supreme court courtroom, adjacent work areas, and offices.
16 (6) The oversight committee shall select a project manager for the project.
17 (7) A legislative member of the oversight committee is entitled to receive
18 compensation in the amount provided per day for members of the legislative
19 management under section 54-35-10 for attending meetings.
20 b. $71,000,000 to the adjutant general, including:
21 (1) $26,000,000 for a Williston armory project;
22 (2) $20,000,000 for a military museum project;
23 (3) $10,000,000 for a Dickinson readiness center project;
24 (4) $9,000,000 for a Camp Grafton fitness facility project; and
25 (5) $6,000,000 for a Camp Grafton training center billets project.
26 4. The funding provided in this section is considered a one-time funding item.
