1 A BILL for an Act to create and enact a new section to chapter 54-21.3 of the North Dakota
2 Century Code, relating to maximum basement depths in residential properties.
3 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
4 SECTION 1. A new section to chapter 54-21.3 of the North Dakota Century Code is created
5 and enacted as follows:
6 Maximum basement depth - Residential property.
7 A one-family or two-family dwelling constructed after August 1, 2023, may not have a
8 basement depth of more than one foot [30.48 centimeters] below the ordinary high water mark
9 of the underlying water table as established by a soil scientist or soil classifier. The department
10 of commerce, in cooperation with the state building code advisory committee, shall adopt rules
11 to implement and update the state building code to comply with this section.
