1 A BILL for an Act to amend and reenact section 25-02-03 of the North Dakota Century Code,
2 relating to the object of the state hospital.
3 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
4 SECTION 1. AMENDMENT. Section 25-02-03 of the North Dakota Century Code is
5 amended and reenacted as follows:
6 25-02-03. Object of state hospital.
7 The state hospital is an institution for mental diseases serving specialized populations of the
8 mentally ill, including persons suffering from drug addiction or alcoholismindividuals with mental
9 illness. The state hospital is one component of the North Dakota mental health delivery system
10 and serves as a resource to community-based treatment programs. The state hospital shall,
11 pursuant to rules adopted by the department of health and human services, receive and care for
12 all mentally ill persons, including persons suffering from drug addiction or alcoholism, residing
13 within this state in accordance with this title, andindividuals with mental illness residing within
14 this state and in accordance with this title who have been sentenced by a court and are in need
15 of forensic psychiatric or substance use disorder services or are in need of a forensic
16 psychiatric evaluation to determine the individual's competency to stand trial. The state hospital
17 shall furnish to those mentally ill personsindividuals with mental illness eligible for services
18 under this section all needed food, shelter, treatment, and support that may tend to restore their
19 mental health or to alleviate their illness or suffering. For purposes of this section, "court" has
20 the same meaning as provided under section 12.1-01-04.
