  A BILL for an Act to amend and reenact section 50-06-01.3 of the North Dakota Century Code,
  relating to appointment and confirmation of the executive director of the department of health
  and human services; and to provide for application.
  BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
      SECTION 1. AMENDMENT. Section 50-06-01.3 of the North Dakota Century Code is
  amended and reenacted as follows:
      50-06-01.3. Appointment of executive director - Confirmation - Compensation.
      The governor shall appoint the executive director of the department who shall serve at the
  pleasure of the governormust be appointed by the governor and confirmed by the senate, and
 shall hold office for a term of four years and until a successor has been appointed, confirmed by
 the senate, and has qualified, unless the executive director is removed sooner as provided
 under this section. If the senate is not in session, the governor may make an interim
 appointment, and the interim appointee shall hold office until the senate confirms or rejects the
 appointment. The executive director's term of office commences on the first day of July in each
 year next following a national presidential election. The governor may remove from office an
 executive director who fails to faithfully discharge the duties of office. The executive director
 shall take the oath of office required of civil officers by section 44-01-05. The executive director
 is entitled to receive compensation in the amount established by the governor within the limits of
 legislative appropriations.
     SECTION 2. APPLICATION. On the effective date of this Act, the governor shall make an
 interim appointment of the executive director of the department of health and human services
 for the unexpired portion of the four-year term.
