1 A BILL for an Act to create and enact a new section to chapter 15.1-27 of the North Dakota
2 Century Code, relating to the allocation of state aid payments for school safety and security
3 measures; and to amend and reenact subsection 3 of section 62.1-02-05 of the North Dakota
4 Century Code, relating to the enactment of less restrictive firearm possession policies or
5 ordinances.
6 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
7 SECTION 1. A new section to chapter 15.1-27 of the North Dakota Century Code is created
8 and enacted as follows:
9 Allocation of state aid for school safety and security measures.
10 1. As used in this section, "school safety and security measures" include:
11 a. Security planning;
12 b. Purchasing security-related technology, including metal detectors, protective
13 lighting, surveillance and monitoring equipment, alarms, special emergency
14 communications equipment, electronic locksets, deadbolts, theft control devices,
15 building access controls, and other similar security devices;
16 c. Training in the use of security-related technology;
17 d. Instituting student, staff, and visitor identification systems, including criminal
18 background check software;
19 e. Updating and exercising school emergency preparedness plans;
20 f. Strengthening partnerships with public safety officials and local law enforcement;
21 g. Modifying, improving, updating, or strengthening the interior or exterior of any
22 school building to prevent unauthorized access to the school; and
23 h. Installing or constructing any barrier on or around school property to prevent
24 unauthorized access to the school.

1 2. Except as provided under subsection 3, a school district shall allocate at least fifteen
2 percent of the state aid payments to which a school district is entitled under section
3 15.1-27-04.1 for school safety and security measures.
4 3. A school district shall allocate at least five percent of the state aid payments to which a
5 school district is entitled under section 15.1-27-04.1 for school safety and security
6 measures if the school district adopts a policy in accordance with subsection 3 of
7 section 62.1-02-05 allowing an individual to carry a firearm or dangerous weapon
8 concealed on school property if the individual meets the requirements of section
9 62.1-04-02 or section 62.1-04-03.1.
10 SECTION 2. AMENDMENT. Subsection 3 of section 62.1-02-05 of the North Dakota
11 Century Code is amended and reenacted as follows:
12 3. This section does not prevent any political subdivision from enacting ana policy or
13 ordinance that is less restrictive than this section relating to the possession of firearms
14 or dangerous weapons at a public gathering. An enacted policy or ordinance
15 supersedes this section within the jurisdiction of the political subdivision.
