1 A BILL for an Act to amend and reenact subsection 3 of section 39-24-04 and section 39-24-11
2 of the North Dakota Century Code, relating to snowmobile registration exemption and penalties;
3 and to provide a penalty.
4 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
5 SECTION 1. AMENDMENT. Subsection 3 of section 39-24-04 of the North Dakota Century
6 Code is amended and reenacted as follows:
7 3. If a snowmobile is exempt from registration under subdivision b or c of subsection 2,
8 the owner is required to purchase an out-of-state public trails and lands access permit
9 received upon payment of a twenty-five dollar per year fee.
10 a. The permit must be in the operator's possessiondisplayed on the snowmobile
11 when thatan individual is operating the snowmobile within the state.
12 b. Dealers or other agents authorized by the director of the parks and recreation
13 department whothat sell out-of-state public trails and lands access permits may
14 retain one dollar of the twenty-five dollar per year fee and the remainder of the
15 fees collected under this subsection must be deposited in the state snowmobile
16 fund.
17 SECTION 2. AMENDMENT. Section 39-24-11 of the North Dakota Century Code is
18 amended and reenacted as follows:
19 39-24-11. Penalties.
20 1. Any person who violates subsection:
21 a. Subsection 12 of section 39-24-09 must be assessed a fee of one hundred
22 dollars. Any person who violates subdivision;
23 b. Subdivision b or g of subsection 5 of section 39-24-09 is guilty of a class B
24 misdemeanor. Any person who violates subdivision;

1 c. Subdivision c of subsection 5 of section 39-24-09 is guilty of an infraction or a
2 class B misdemeanor as determined by section 39-24.1-07. Any person who
3 violates subsection;
4 d. Subsection 11 of section 39-24-09 is guilty of a class B misdemeanor and must
5 be assessed a fine of at least one hundred dollars. Any person who violates any;
6 and
7 e. Any other provision of section 39-24-09 must be assessed a fee of twenty dollars.
8 2. Any person, unless specifically exempted, who fails to register or fails to display a
9 decal or permit as required by sections 39-24-02 and 39-24-04 must be assessed a
10 fee of fifty dollars. If the person provides proof of registration after the violation, the fee
11 may be reduced by one-half.
12 3. Any person who violates any other provision of this chapter for which a specific
13 penalty is not provided must be assessed a fee of ten dollars.
