1 A BILL for an Act to amend and reenact section 50-24.4-17 of the North Dakota Century Code,
2 relating to nursing home rate adjustments.
3 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
4 SECTION 1. AMENDMENT. Section 50-24.4-17 of the North Dakota Century Code is
5 amended and reenacted as follows:
6 50-24.4-17. Adjustments and reconsiderationReconsideration procedures.
7 1. Rate adjustments may be made to correct errors subsequently determined and must
8 also be retroactive to the beginning of the facility's rate year except with respect to
9 rates paid by private-paying residents. Any adjustments that result in a cumulative
10 change of more than one dollar per day from the desk rate will be included in the next
11 subsequent cost report to the extent not corrected by a rate adjustment made
12 pursuant to this subsection.
13 2. Any requests for reconsideration of the rate must be filed with the department's
14 medical services division for administrative consideration within thirty days of the date
15 of the rate notification.
