1 A BILL for an Act to amend and reenact subsection 2 of section 43-41-04 and subsection 4 of
2 section 43-41-09 of the North Dakota Century Code, relating to the licensure of social workers.
3 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
4 SECTION 1. AMENDMENT. Subsection 2 of section 43-41-04 of the North Dakota Century
5 Code is amended and reenacted as follows:
6 2. To obtain a license to engage in the practice of social work, an applicant shall submit
7 an application to the board in the form prescribed by the board and provide evidence
8 satisfactory to the board the applicant:
9 a. Has attained the age of majority.
10 b. HasIf required by the board, has passed the examination approved by the board
11 for the license sought, has received a waiver for this examination requirement, or
12 has completed examination alternative requirements set forth by the board.
13 c. Has satisfied the board the applicant agrees to adhere to the code of social work
14 ethics adopted by the board.
15 d. Is of good moral character. As an element of good moral character, the board
16 shall consider the applicant's adherence to values, principles, and ethical
17 standards consistent with professional social work practice, and also shall also
18 consider information obtained through reports made under section 43-41-04.2 in
19 licensure decisions to the extent permissible by all applicable laws.
20 e. Has paid all applicable fees specified by the board relative to the licensure
21 process.
22 SECTION 2. AMENDMENT. Subsection 4 of section 43-41-09 of the North Dakota Century
23 Code is amended and reenacted as follows:
24 4. Approve examinationslicensure for licensing social workers. The board may:

1 a. Suspend the use of an examination for licensure.
2 b. Waive examination requirements and create a process under which an applicant
3 may apply for a waiver to licensure examination requirements.
4 c. Create alternative requirements that do not require an examination to ascertain
5 the qualifications and fitness of a candidate for a license to engage in the practice
6 of social work.
