1 A BILL for an Act to create and enact a new section to chapter 15.1-14 of the North Dakota
2 Century Code, relating to limiting compensation for school district superintendents.
3 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
4 SECTION 1. A new section to chapter 15.1-14 of the North Dakota Century Code is created
5 and enacted as follows:
6 School district superintendent - Limitation on compensation.
7 1. For purposes of this section, "low enrollment school district" means a school district
8 with fewer than four hundred seventy-five enrolled students.
9 2. An individual who serves as a superintendent of one or more school districts in the
10 state must serve at least four hundred seventy-five students. If two or more school
11 districts jointly hire a superintendent, the school districts may combine the total
12 number of students enrolled in grades kindergarten through twelve in those districts to
13 meet the requirements of this section.
14 3. The total compensation a school district provides to the school district's
15 superintendent may not exceed one and one-half percent of the total state and local
16 general fund revenue received by the school district. The amount of total
17 compensation includes compensation the superintendent receives for other duties
18 performed within the school district.
19 4. Beginning with the 2024-25 school year, a low enrollment school district shall partner
20 with one or more school districts to jointly employ a superintendent. By January 1,
21 2024, a low enrollment school district shall report to the superintendent of public
22 instruction which school district the low enrollment school district will partner with to
23 jointly employ a superintendent beginning with the 2024-25 school year. If a low
24 enrollment school district does not report to the superintendent of public instruction by

1 January 1, 2024, the superintendent of public instruction or the state board of public
2 school education shall decide which school district the low enrollment school district
3 must partner with to jointly employ a superintendent. The total compensation provided
4 to a superintendent for all duties performed within those school districts may not
5 exceed one and one-half percent of the total state and local general fund revenue
6 received by those school districts.
7 5. If enrollment at a school district falls below four hundred seventy-five students, a
8 superintendent may submit to the superintendent of public instruction a waiver on a
9 form provided by the department of public instruction. A school district for which a
10 waiver is submitted is exempt from the requirements under this section for one year.
