1 A BILL for an Act to amend and reenact sections 58-04-01, 58-05.1-07, 58-06-02, 58-07-01, and
2 58-08-01 of the North Dakota Century Code, relating to township officials.
3 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
4 SECTION 1. AMENDMENT. Section 58-04-01 of the North Dakota Century Code is
5 amended and reenacted as follows:
6 58-04-01. Annual township meeting - When held - Change in meeting place - Notice.
7 The electors of each township annually shall assemble and hold a township meeting on the
8 third Tuesday in the month of March at suchthe place in the township or in an adjacent township
9 asdesignated by the board of township supervisors thereof shall designate. Notice of the time
10 and place of holding the meeting must be given by the township clerk at least ten days prior
11 tobefore the meeting by publication in a legal newspaper published in the township or, if there is
12 no such newspaper, then in the county's official newspaper. Before a change in the place of
13 holding the annual township meeting is made, notice of the contemplated change may be given
14 by any member of the board of township supervisors to the township clerk, who shall have such
15 change published if time allows. Otherwise, the township clerk shall post notice of the change.
16 WhereIf an incorporated city is wholly or partially within the boundaries of the township or an
17 adjacent township, all township meetings may be held in suchat the place within suchan
18 incorporated city, as designated by the board of township supervisors thereof may designate.
19 SECTION 2. AMENDMENT. Section 58-05.1-07 of the North Dakota Century Code is
20 amended and reenacted as follows:
21 58-05.1-07. Multitownship board - Election.
22 On the third Tuesday of March followingFollowing the annual township meeting under
23 section 58-04-01 and the consolidation election, a multitownship meeting must be held and the
24 qualified electors shall elect a multitownship board of supervisors. If the number of consolidated

1 townships is five or fewer, the multitownship board of supervisors must consist of one
2 supervisor elected from each township. If the number of consolidated townships is two or four,
3 an additional township supervisor must be elected at large so the multitownship board consists
4 of three or five members. The length of the terms of the supervisors first elected must be
5 staggered so that the terms of an equal amount of supervisors, or as nearly as practicable,
6 expire each year. In addition, the qualified electors shall elect a multitownship clerk and a
7 multitownship treasurer. The multitownship officers elected at the annual meeting shall assume
8 all the powers and duties of the township officers of the townships approving the consolidation.
9 SECTION 3. AMENDMENT. Section 58-06-02 of the North Dakota Century Code is
10 amended and reenacted as follows:
11 58-06-02. Compensation of supervisors.
12 A township supervisor is entitled tomay receive as compensation for services up to
13 sixtyone hundred dollars a day for each day necessarily devoted to the work of a supervisor's
14 office not exceeding twofour thousand dollars in a calendar year. The electors of the township
15 shall establish the daily compensation rate for township supervisors at each annual township
16 meeting. Additional compensation over twofour thousand dollars may be provided for
17 reimbursement of expenses as provided in section 44-08-04 and for mileage as provided in
18 section 54-06-09 for each mile [1.61 kilometers] necessarily traveled in the performance of a
19 supervisor's duties.
20 SECTION 4. AMENDMENT. Section 58-07-01 of the North Dakota Century Code is
21 amended and reenacted as follows:
22 58-07-01. Compensation of clerk.
23 The township clerk is entitled tomay receive as compensation for services up to
24 sixtyone hundred dollars a day for each day necessarily devoted to the work of the clerk's office
25 not exceeding twofour thousand dollars in a calendar year. The electors of the township shall
26 establish the daily compensation rate for the township clerk at each annual township meeting.
27 Additional compensation over twofour thousand dollars may be provided for reimbursement of
28 expenses as provided in section 44-08-04 and for mileage as provided in section 54-06-09 for
29 each mile [1.61 kilometers] necessarily traveled in the performance of the clerk's duties. In
30 those townships in which the offices of township clerk and treasurer have been merged, the
31 individual elected to fill the new office is entitled to receive compensation as township clerk only.

1 SECTION 5. AMENDMENT. Section 58-08-01 of the North Dakota Century Code is
2 amended and reenacted as follows:
3 58-08-01. Compensation of treasurer.
4 The township treasurer is entitled tomay receive as compensation for services up to
5 sixtyone hundred dollars a day for each day necessarily devoted to the work of the treasurer's
6 office not exceeding twofour thousand dollars in a calendar year. The electors of the township
7 shall establish the daily compensation rate for the township treasurer at each annual township
8 meeting. Additional compensation over twofour thousand dollars may be provided for
9 reimbursement of expenses as provided in section 44-08-04 and for mileage as provided in
10 section 54-06-09 for each mile [1.61 kilometers] necessarily traveled in the performance of the
11 treasurer's duties. The township treasurer may not be allowed a percentage on the balance
12 turned over to the treasurer's successor in office.
