1 A BILL for an Act to provide an appropriation to the department of transportation for
2 transportation projects to alleviate flooding impacts; to provide for a department of
3 transportation study; and to provide for a report to the legislative management.
4 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
5 SECTION 1. APPROPRIATION - DEPARTMENT OF TRANSPORTATION. There is
6 appropriated out of any moneys in the strategic investment and improvements fund in the state
7 treasury, not otherwise appropriated, the sum of $37,250,000, or so much of the sum as may be
8 necessary, to the department of transportation for phase one of a project to address northern
9 Red River valley flooding concerns, for the biennium beginning July 1, 2023, and ending
10 June 30, 2025. The appropriation under this section is available for design, redesign,
11 preliminary and final engineering, environmental analysis, right of way acquisition, and
12 construction, including demolition. The appropriation under this section may be used only for
13 acquisitions and improvements within the state. The appropriation provided under this section is
14 a one-time funding item.
15 SECTION 2. DEPARTMENT OF TRANSPORTATION STUDY TO ALLEVIATE
16 NORTHERN RED RIVER VALLEY FLOODING - REPORT TO LEGISLATIVE MANAGEMENT.
17 The department of transportation shall study a proposed transportation project in the northern
18 Red River valley to alleviate flooding. As part of the study, the department shall:
19 1. Determine the cost-share responsibility for all phases of the project, including the
20 amount of project costs to be paid by the department of transportation, the department
21 of water resources, the state of Minnesota, the federal government, and private
22 railroads;
23 2. Evaluate the economic impact of flooding to the area over a historical and projected
24 basis;

1 3. Estimate the total cost of phase one of the project which includes replacing various
2 bridges in identified areas; and
3 4. Recommend funding options for all phases of the project.
4 The department of transportation shall report its findings and recommendations to the legislative
5 management before August 1, 2024.
