1 A BILL for an Act to create and enact a new subdivision to subsection 2 of section 12-63-04 of
2 the North Dakota Century Code, relating to powers of the peace officer standards and training
3 board; and to amend and reenact section 12-63-01 and subsection 1 of section 12-63-02.3 of
4 the North Dakota Century Code, relating to reserve peace officer licenses.
5 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
6 SECTION 1. AMENDMENT. Section 12-63-01 of the North Dakota Century Code is
7 amended and reenacted as follows:
8 12-63-01. Definitions.
9 As used in this chapter:
10 1. "Board" means the peace officer standards and training board.
11 2. "Part-time peace officer license" means a license issued to an individual authorized by
12 law or appointed by a criminal justice agency of this state on a salaried or nonsalaried
13 basis to enforce the law and to conduct or engage in investigations of violations of the
14 law for no more than an average of twenty hours per week, not including time spent on
15 call when no call to active duty is received, calculated on an annual basis.
16 3. "Peace officer" means a public servant authorized by law or by government agency or
17 branch to enforce the law and to conduct or engage in investigations of violations of
18 the law.
19 4. "Reserve peace officer license" means a license issued to an individual authorized by
20 law or appointed by a criminal justice agency of this state on a salaried or nonsalaried
21 basis to enforce the law and to conduct or engage in investigations of violations of the
22 law within the scope of the reserve peace officer's training.
23 SECTION 2. AMENDMENT. Subsection 1 of section 12-63-02.3 of the North Dakota
24 Century Code is amended and reenacted as follows:

1 1. Except as otherwise provided in this section, all provisions of this chapter apply to
2 licensed reserve peace officers and a licensed reserve peace officer has the same
3 authority as a licensed peace officer.
4 SECTION 3. A new subdivision to subsection 2 of section 12-63-04 of the North Dakota
5 Century Code is created and enacted as follows:
6 Expend funds to sponsor training for instruction of licensees, including up to fifty
7 thousand dollars annually from fees collected by the board.
