1 A BILL for an Act to provide an appropriation to the department of career and technical
2 education for the statewide area and career center initiative grant program; to authorize a Bank
3 of North Dakota line of credit; to provide an exemption; and to declare an emergency.
4 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
5 SECTION 1. APPROPRIATION - DEPARTMENT OF CAREER AND TECHNICAL
6 EDUCATION - STATEWIDE AREA AND CAREER CENTER INITIATIVE GRANT PROGRAM -
7 ONE-TIME FUNDING. There is appropriated out of any moneys in the general fund in the state
8 treasury, not otherwise appropriated, the sum of $2,000,000, or so much of the sum as may be
9 necessary, to the department of career and technical education for the purpose of paying
10 accrued interest on a Bank of North Dakota line of credit used for the statewide area and career
11 center initiative grant program, for the period beginning with the effective date of this Act, and
12 ending June 30, 2025. This funding is considered a one-time funding item.
13 SECTION 2. BANK OF NORTH DAKOTA - LINE OF CREDIT - APPROPRIATION -
14 DEPARTMENT OF CAREER AND TECHNICAL EDUCATION - STATEWIDE AREA AND
15 CAREER CENTER INITIATIVE GRANT PROGRAM. The Bank of North Dakota shall extend a
16 line of credit not to exceed $68,276,228 to the department of career and technical education at
17 the prevailing interest rate charged to North Dakota governmental entities, the sum of which is
18 appropriated to the department of career and technical education for the purpose of providing
19 grants to entities approved by the state board for career and technical education to build career
20 academies through the statewide area and career center initiative grant program for the period
21 beginning with the effective date of this Act, and ending June 30, 2025. The department shall
22 repay the line of credit and accrued interest from funding appropriated from the general fund in
23 section 1 of this Act and from funding appropriated from the federal coronavirus capital projects
24 fund in section 1 of chapter 548 of the 2021 Session Laws. If moneys available on June 30,

1 2025, are not sufficient to repay the line of credit, the department of career and technical
2 education shall request from the sixty-ninth legislative assembly a deficiency appropriation to
3 repay the line of credit.
4 SECTION 3. EXEMPTION - STATEWIDE AREA AND CAREER CENTER INITIATIVE
5 GRANT PROGRAM. The amount of $68,276,228 appropriated from the federal coronavirus
6 capital projects fund to the department of career and technical education for the statewide area
7 and career center initiative grant program in section 1 of chapter 548 of the 2021 Session Laws
8 is not subject to section 54-44.1-11 and may be continued and is available to the department of
9 career and technical education for the program during the biennium beginning July 1, 2023, and
10 ending June 30, 2025.
11 SECTION 4. EMERGENCY. Sections 1 and 2 of this Act are declared to be an emergency
12 measure.
