1 A BILL for an Act to amend and reenact section 47-04.1-03 of the North Dakota Century Code,
2 relating to the contents of a recorded declaration for a condominium project.
3 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
4 SECTION 1. AMENDMENT. Section 47-04.1-03 of the North Dakota Century Code is
5 amended and reenacted as follows:
6 47-04.1-03. Contents of declaration.
7 The declaration provided for in section 47-04.1-02 shall contain:
8 1. A description or survey map of the surface of the land included within the project.
9 2. Diagrammatic floor plans of the structures built or to be built thereon in sufficient detail
10 to identify each unit, its relative location and approximate dimensions.
11 3. A description of the common elements.
12 4. A description of the limited common elements.
13 5. The fractional or percentage interest which each unit bears to the entire project. The
14 sum of such shall be one if expressed in fractions and one hundred if expressed in
15 percentage.
16 6. A notarized certification of approval from the building inspector or other appropriate
17 official having the authority to act on behalf of the city, township, or county maintaining
18 jurisdiction over the location of the project.
