1 A BILL for an Act to create and enact a new section to chapter 37-18 of the North Dakota
2 Century Code, relating to creation of the military honors funeral funds and reimbursement for
3 funeral services; to provide an appropriation; and to provide a continuing appropriation.
4 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
5 SECTION 1. A new section to chapter 37-18 of the North Dakota Century Code is created
6 and enacted as follows:
7 Military honors funeral fund - Veterans' service organization reimbursement
8 -Continuing appropriation.
9 1. A special fund is established in the state treasury and designated as the military
10 honors funeral fund.
11 2. All money deposited in the fund is appropriated as a continuing appropriation to the
12 department of veterans' affairs for use in providing reimbursements under this section.
13 3. The department shall administer a program to reimburse a veterans' service
14 organization for providing a funeral service at a military honors funeral.
15 4. Upon the request of a veterans' service organization, the department shall reimburse
16 up to fifty dollars to one veterans' service organization per funeral for providing a
17 funeral service during a military honors funeral.
18 5. The veterans' service organization may authorize the playing of taps on a ceremonial
19 bugle or a high-quality recording during a military honors funeral held in this state for a
20 deceased veteran.
21 6. As used in this section, a "funeral service" includes a:
22 a. Folding of the flag;
23 b. Presentation of the flag;
24 c. Presentation of the state coin;

1 d. Playing of taps; and
2 e. Three volley salute.
3 SECTION 2. APPROPRIATION - DEPARTMENT OF VETERANS' AFFAIRS - FUNERAL
4 SERVICE REIMBURSEMENT. There is appropriated out of any moneys in the general fund in
5 the state treasury, not otherwise appropriated, the sum of $200,000, or so much of the sum as
6 may be necessary, to the department of veterans' affairs for deposit in the military honors
7 funeral fund for the purpose of providing reimbursement to a veterans' service organization that
8 provides a funeral service under section 1 of this Act, for the biennium beginning July 1, 2023,
9 and ending June 30, 2025.
