1 A BILL for an Act to amend and reenact section 61-04.1-39 of the North Dakota Century Code,
2 relating to state funding requirements for county weather modification operations.
3 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
4 SECTION 1. AMENDMENT. Section 61-04.1-39 of the North Dakota Century Code is
5 amended and reenacted as follows:
6 61-04.1-39. Payment for weather modification - State to provide funds.
7 1. Any weather modification authority or person that contracted with the board for
8 weather modification operations under this chapter shall appropriate to the state
9 weather modification fund the amount determined by the board to be necessary to
10 provide that weather modification authority or person with weather modification
11 operations.
12 2. The board may expend, from the state weather modification fund, the funds the board
13 deems necessary to provide a contracting weather modification authority or person
14 with weather modification operations. Before the board expends these funds, the
15 board shall obtain approval from the board of county commissioners in:
16 a. Each county in which the participating weather modification authority or person
17 will conduct weather modification operations; and
18 b. Each county bordering a county in which the weather modification authority or
19 person will conduct weather modification operations.
