1 A BILL for an Act to amend and reenact subsection 3 of section 23-46-01 and section 23-46-04
2 of the North Dakota Century Code, relating to state financial assistance for emergency medical
3 services; and to provide an effective date.
4 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
5 SECTION 1. AMENDMENT. Subsection 3 of section 23-46-01 of the North Dakota Century
6 Code is amended and reenacted as follows:
7 3. "Required local matching funds" means revenue generated by the provision of
8 emergency medical services, local mill levies, local sales tax, local donations, and
9 in-kind donations of servicesproperty taxes levied by a taxing district to provide
10 funding to an emergency medical services operation.
11 SECTION 2. AMENDMENT. Section 23-46-04 of the North Dakota Century Code is
12 amended and reenacted as follows:
13 23-46-04. State financial assistance for emergency medical services - Confidential
14 information - Annual allocation - Qualification.
15 1. Emergency medical services operations that request financial assistance from the
16 state must provide requested fiscal information to the department of health and human
17 services for use in financial assistance determinations. All information provided to the
18 department under this section is confidential.
19 2. The department of health and human services shall determine annually the allocation
20 amount of state financial assistance for each emergency medical services funding
21 area based on the department's determination of the minimum annual funding
22 necessary to operate the qualified emergency medical services operation or service
23 designated to operate in the ambulanceemergency medical services funding area,

1 based on the financial needs unique to each emergency medical services funding
2 area.
3 3. To qualify for financial assistance under this section, an emergency medical services
4 operation or service designated to operate in an emergency medical services funding
5 area must receive required local funds.
6 SECTION 3. EFFECTIVE DATE. This Act becomes effective on July 1, 2024.
