1 A BILL for an Act to create and enact a new section to chapter 12.1-20 of the North Dakota
2 Century Code, relating to sexual reproductive imposition; and to provide a penalty.
3 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
4 SECTION 1. A new section to chapter 12.1-20 of the North Dakota Century Code is created
5 and enacted as follows:
6 Sexual reproductive imposition.
7 1. As used in this section:
8 a. "Donor" means an individual who donates reproductive material, regardless of
9 whether for personal use or compensation.
10 b. "Egg" means the unfertilized female reproductive cell.
11 c. "Health care provider" means an individual licensed or certified by the state to
12 deliver health care. The term includes an individual licensed to practice medicine
13 or osteopathy under chapter 43-17.
14 d. "Pre-embryo" means the product of fertilization of an egg by a sperm until the
15 appearance of the embryonic axis.
16 e. "Recipient" means an individual who receives reproductive material from a donor.
17 f. "Reproductive material" includes any human egg, pre-embryo, or sperm.
18 g. "Sperm" means the male reproductive cell.
19 2. A health care provider may not intentionally penetrate the vagina of a recipient with the
20 reproductive material of a donor or any object containing the reproductive material of a
21 donor, knowing the recipient has not consented to the use of the reproductive material
22 from that donor.
23 3. A violation of this section is a class C felony.

1 4. Notwithstanding section 29-04-02, the applicable period of limitation for prosecution of
2 a violation under this section does not begin to run until the date on which the violation
3 is discovered and reported to law enforcement authorities.
