1 A BILL for an Act to amend and reenact section 23-47-02 of the North Dakota Century Code,
2 relating to system registries for a comprehensive emergency cardiovascular medical system.
3 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
4 SECTION 1. AMENDMENT. Section 23-47-02 of the North Dakota Century Code is
5 amended and reenacted as follows:
6 23-47-02. Acute cardiovascular emergency medical system - Duties of department.
7 1. Following consultation with and receipt of a recommendation of the acute
8 cardiovascular emergency medical system of care advisory committee, the
9 department shall establish and maintain a comprehensive emergency cardiovascular
10 medical system for the state. The system must include standards for the following
11 components:
12 a. A system plan.
13 b. Prehospital emergency medical services.
14 c. Hospitals, for which the standards must include:
15 (1) Standards for designation, redesignation, and dedesignation of receiving
16 and referring centers.
17 (2) Standards for evaluation and quality improvement programs for designated
18 centers.
19 (3) Recognition of a hospital as a STEMI receiving center or as a STEMI
20 referring center. In making such recognition, the standards must include
21 consideration of whether the hospital is:
22 (a) Accredited as a mission: lifeline STEMI receiving center or mission:
23 lifeline STEMI referring center by the society of cardiovascular patient
24 care and the American heart association accreditation process; or

1 (b) Accredited by a department-approved, nationally recognized
2 organization that provides mission: lifeline STEMI receiving center
3 and mission: lifeline STEMI referring center accreditation or a
4 substantive equivalent.
5 d. System registries, for which the components must include a plan for achieving
6 continuous quality improvement in the quality of care provided under the
7 statewide system, including for STEMI response and treatment.
8 (1) In implementing this plan, the department shall maintain a statewide STEMI
9 heart attack database that aggregates information and statistics on heart
10 attack care. The department shall utilize the ACTION registry-get with the
11 guidelines data platform, or other equivalent platform.
12 (2) To the extent possible, the department shall coordinate with national
13 voluntary health organizations involved in STEMI heart attack quality
14 improvement to avoid duplication and redundancy.
15 (3) Designated receiving centers shall participate in the registry.
16 2. The proceedings and records of the program are not subject to subpoena, discovery,
17 or introduction into evidence in any civil action arising out of any matter that is the
18 subject of consideration by the program.
