1 A BILL for an Act to create and enact section 24-02-45.4 of the North Dakota Century Code,
2 relating to the authorization and appropriations necessary to administer the national electric
3 vehicle infrastructure program grants and other discretionary funding items; and to provide a
4 continuing appropriation.
5 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
6 SECTION 1. Section 24-02-45.4 of the North Dakota Century Code is created and enacted
7 as follows:
8 24-02-45.4. Federal electric vehicle infrastructure grants - Cooperative agreements
9 with public or private entities for the administration of federal aid programs - Continuing
10 appropriation.
11 1. Notwithstanding any other provision of law, the director is authorized and empowered
12 to do all things necessary and make all necessary agreements to acquire, be
13 appropriated funds for, and administer electric vehicle charging grants and acquire any
14 associated discretionary funding that may become available. The director may enter a
15 cooperative agreement with a public or private entity, for the purpose of administering
16 federal aid electric vehicle charging programs. The director is authorized to determine
17 a reasonable cost-share for the project in accordance with federal aid provisions. The
18 director or the public or private entity, may construct, operate, administer, and maintain
19 the project. If the department constructs the project, the private entity's cost-share
20 must be paid for in advance of the construction by the private entity before the
21 department can construct the project. The director may turn over the project to the
22 private entity when the project meets federal requirements. The department may
23 charge a fee for any department-owned charging infrastructure, to cover the
24 department's costs of providing electricity for charging.

1 2. There is created in the state treasury a fund known as the electric vehicle charging
2 fund. Funds received pursuant to this section must be deposited into the electric
3 vehicle charging fund and are appropriated to the department as a continuing
4 appropriation and may be used to fund necessary electric vehicle charging
5 infrastructure.
