1 A BILL for an Act to create and enact section 39-21-39.1 of the North Dakota Century Code,
2 relating to windows impairing vision of a driver; and to amend and reenact section 39-10-24 of
3 the North Dakota Century Code, relating to stop and yield signs.
4 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
5 SECTION 1. AMENDMENT. Section 39-10-24 of the North Dakota Century Code is
6 amended and reenacted as follows:
7 39-10-24. Stop signs and yield signs.
8 1. Preferential right of way may be indicated by stop signs or yield signs as authorized in
9 section 39-07-03.
10 2. Except when directed to proceed by a police officer, every driver of a vehicle
11 approaching a stop sign shall stop at a clearly marked stop line, or, if none, then at the
12 point nearest the intersecting roadway where the driver has a view of approaching
13 traffic on the intersecting roadway before entering it. After having stopped, the driver
14 shall yield the right of way to any vehicle in the intersection or approaching on another
15 roadway so closely as to constitute an immediate hazard during the time when such
16 driver is moving across or within the intersection or junction of roadways. If more than
17 one vehicle arrives at an intersection controlled by two or more stop signs, the driver
18 of the vehicle that comes to a complete stop first has the right of way to proceed
19 through the intersection followed by the next vehicle that stopped.
20 3. The driver of a vehicle approaching a yield sign shall in obedience to such sign slow
21 down to a speed reasonable for the existing conditions and, if required for safety to
22 stop, shall stop at a clearly marked stop line, or, if none, before entering the crosswalk
23 on the near side of the intersection, or, if none, then at the point nearest the
24 intersecting roadway where the driver has a view of approaching traffic on the

1 intersecting roadway before entering it. After slowing or stopping, the driver shall yield
2 the right of way to any vehicle in the intersection or approaching on another roadway
3 so closely as to constitute an immediate hazard during the time such driver is moving
4 across or within the intersection or junction of roadways. Provided, however, that if a
5 driver is involved in a collision with a vehicle in the intersection or junction of roadways
6 after driving past a yield sign without stopping, such collision is deemed prima facie
7 evidence of the driver's failure to yield the right of way.
8 SECTION 2. Section 39-21-39.1 of the North Dakota Century Code is created and enacted
9 as follows:
10 39-21-39.1. Windows impairing vision of drivers.
11 Glass or glazing material on the front or side windows may not be cracked, broken,
12 shattered, or distorted to the extent it impairs the vision of the driver.
