1 A BILL for an Act to amend and reenact subsection 6 of section 38-22-06 of the North Dakota
2 Century Code, relating to the delivery of permit hearing notices.
3 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
4 SECTION 1. AMENDMENT. Subsection 6 of section 38-22-06 of the North Dakota Century
5 Code is amended and reenacted as follows:
6 6. Service of hearingHearing notices required by this section must conform to personal
7 service provisions in rule 4 of the North Dakota Rules of Civil Procedurebe completed
8 by mail or third-party commercial delivery, tracking service requested, and addressed
9 to the last address of record for the individual or entity to be served. The notice by
10 publication set forth in subsection 2 applies to all individuals and entities that cannot
11 be served under this section.
