1 A BILL for an Act to amend and reenact section 15.1-18-10 of the North Dakota Century Code,
2 relating to criteria for teacher permits; and to provide an expiration date.
3 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
4 SECTION 1. AMENDMENT. Section 15.1-18-10 of the North Dakota Century Code is
5 amended and reenacted as follows:
6 15.1-18-10. Specialty areas - Teacher qualification. (Effective through July 31,
7 20232031)
8 Notwithstanding the requirements of this chapter:
9 1. An individual may teach art, business education, computer education, a foreign
10 language, music, physical education, special education, and technology education at
11 any grade level from kindergarten through grade eight, provided the individual:
12 a. Is licensed to teach by the education standards and practices board;
13 b. Is approved to teach in that area by the education standards and practices board;
14 and
15 c. Meets all requirements set forth in rule by the superintendent of public instruction.
16 2. An individual may teach Native American languages provided the individual is an
17 eminence-credentialed teacher.
18 3. An individual may teach in the areas of trade, industry, technical occupations, or health
19 occupations, provided the individual has been issued a license to teach in such areas
20 by the education standards and practices board.
21 4. An individual may teach in any subject, except elementary education, special
22 education, mathematics, science, language arts, and social studies, if the individual:
23 a. Has a permit issued by the board and has a high school diploma;

1 b. (1) Possesses at least four thousand hours over five years of relevant work
2 experience in the subject area to be taught; or
3 (2) Possesses a certificate, permit, or degree in the subject area to be taught;
4 and
5 c. Enrolls in the North Dakota teacher support system approved mentor program,
6 expensed to the sending district.
7 5. The board of a school district may authorize an individual to teach under subsection 4
8 for one year, up to a maximum of three years, if:
9 a. The administrator of a school within the district submits a written request to the
10 education standards and practices board which indicates the administrator is
11 unable to locate a qualified applicant and requests the education standards and
12 practices board issue a permit;
13 b. The individual successfully completes a background check conducted by the
14 education standards and practices board; and
15 c. The education standards and practices board issues a permit to the individual.
16 6. For an individual authorized to teach under subsection 5, the board of a school district
17 may authorize the individual to teach for an additional three years, up to a maximum of
18 six years, if the individual also is enrolled in a teacher education program.
19 7. The board may adopt rules to administer teaching permits under this section.
20 7.8. The board of a school district may terminate the employment of an individual with a
21 teaching permit issued under this section at will.
