1 A concurrent resolution urging Congress to refrain from issuing a vaccine passport and from
2 enacting any law that would restrict an individual's right to travel or participate in commerce,
3 religious freedom, and education based on whether the individual has received a COVID-19
4 vaccine.
5 WHEREAS, the Founding Fathers deemed a Bill of Rights was necessary to guard an
6 individual's liberty against encroachments from state and federal actions, both public and
7 private; and
8 WHEREAS, no COVID-19 vaccine has been officially approved by the federal Food and
9 Drug Administration; and
10 WHEREAS, emergency use products are prohibited by federal law under 21 U.S.C.
11 360bbb-3 from being mandated insofar as individuals must be informed of "the option to accept
12 or refuse administration of the product"; and
13 WHEREAS, in August 2020 the Centers for Disease Control and Prevention Advisory
14 Committee on Immunization Practices affirmed under an emergency use authorization,
15 experimental vaccines may not be made mandatory; and
16 WHEREAS, universally accepted codes of medical ethics, including the Nuremberg Code
17 and the Declaration of Helsinki, absolutely prohibit any form of coercion to make individuals
18 participate in a medical experiment; and
19 WHEREAS, public and private measures are being considered to mandate experimental
20 vaccination to participate in certain public activities and functions of daily American life,
21 including employment, in-person school attendance, public transportation, and concert
22 performances; and
23 WHEREAS, Section 1 of Article I of the Constitution of North Dakota provides "[a]ll
24 individuals are by nature equally free and independent and have certain inalienable rights,
25 among which are those of enjoying and defending life and liberty; acquiring, possessing and

1 protecting property and reputation; pursuing and obtaining safety and happiness; and to keep
2 and bear arms for the defense of their person, family, property, and the state, and for lawful
3 hunting, recreational, and other lawful purposes, which shall not be infringed"; and
4 WHEREAS, "vaccine passports," "digital health Ids," and other similar required
5 documentations pose substantial risks to personal privacy and equal treatment before the law
6 for all North Dakotans and United States citizens;
7 NOW, THEREFORE, BE IT RESOLVED BY THE SENATE OF NORTH DAKOTA, THE
8 HOUSE OF REPRESENTATIVES CONCURRING THEREIN:
9 That the Sixty-seventh Legislative Assembly urges the Congress of the United States to
10 refrain from issuing a vaccine passport and from enacting any law that would restrict an
11 individual's right to travel or participate in commerce, religious freedom, and education based on
12 whether the individual has received a COVID-19 vaccine; and
13 BE IT FURTHER RESOLVED, that the Secretary of State forward copies of this resolution
14 to the Secretary of the United State Department of Health and Human Services, the Majority
15 and Minority Leaders of the United States Senate and the United States House of
16 Representatives, and to each member of the North Dakota Congressional Delegation.
