1 A BILL for an Act to amend and reenact sections 15.1-21-02.4 and 15.1-21-02.5 of the North
2 Dakota Century Code, relating to scholarship eligibility requirements; and to declare an
3 emergency.
4 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
5 SECTION 1. AMENDMENT. Section 15.1-21-02.4 of the North Dakota Century Code is
6 amended and reenacted as follows:
7 15.1-21-02.4. North Dakota career and technical education scholarship. (Effective
8 through July 31, 2021)
9 1. Any resident student who graduates from a high school during or after the 2010-11
10 school year and any resident student who completes a program of home education
11 supervised in accordance with chapter 15.1-23 during or after the 2012-13 school year
12 is eligible to receive a North Dakota career and technical education scholarship
13 provided the student:
14 1. a. Completed four units of English language arts from a sequence that includes
15 literature, composition, and speech;
16 2. b. Completed three units of mathematics, including:
17 a. (1) One unit of algebra II, as defined by the superintendent of public instruction;
18 and
19 b. (2) Two units of any other mathematics, which may include one unit of
20 computer science;
21 3. c. Completed three units of science, consisting of:
22 a. (1) (a) One unit of biology;
23 (2) (b) One unit of chemistry; and
24 (3) (c) One unit of physics; or

1 b. (1)(2) (a) One unit of biology;
2 (2) (b) One unit of physical science; and
3 (3) (c) One unit or two one-half units of any other science;
4 4. d. Completed three units of social studies, including:
5 a. (1) One unit of United States history;
6 b. (1)(2) (a) One-half unit of United States government and one-half unit of
7 economics; or
8 (2) (b) One unit of problems of democracy; and
9 c. (3) One unit or two one-half units of any other social studies, which may include
10 civics, civilization, geography and history, multicultural studies, North Dakota
11 studies, psychology, sociology, and world history;
12 5. a.e. (1) Completed one unit of physical education; or
13 b. (2) One-half unit of physical education and one-half unit of health;
14 6. f. Completed:
15 a. (1) One unit selected from:
16 (1) (a) Foreign languages;
17 (2) (b) Native American languages;
18 (3) (c) American sign language;
19 (4) (d) Fine arts; or
20 (5) (e) Career and technical education courses; and
21 b. (2) Two units of a coordinated plan of study recommended by the department of
22 career and technical education and approved by the superintendent of
23 public instruction or an education pathway approved by the superintendent
24 of public instruction. The education pathway must consist of two units in
25 teaching profession and educational methodology and at least one
26 additional unit in advanced placement or dual-credit psychology, child
27 development, peer-to-peer leadership, or child-related careers;
28 7. g. Completed any five additional units, two of which must be in the area of career
29 and technical education;
30 8.a.h.(1) (a) Obtained a cumulative grade point average of at least 3.0 on a 4.0
31 grading scale, as determined by the superintendent of public

1 instruction, based on all high school units in which the student was
2 enrolled; and
3 (2) (b) Obtained a grade of at least "C" in each unit or one-half unit, except
4 as provided under subsection 2; or
5 b. (1)(2) (a) Obtained a cumulative grade point average of at least 3.0 on a 4.0
6 grading scale, as determined by the superintendent of public
7 instruction, based only on the units required by subsections 1 through
8 7; and
9 (2) (b) Obtained a grade of at least "C" in each unit or one-half unit, except
10 as provided under subsection 2; and
11 9. i. Received:
12 a. (1) A composite score of at least twenty-four on an ACT; or
13 b. (2) A score of at least five on each of three WorkKeys assessments
14 recommended by the department of career and technical education and
15 approved by the superintendent of public instruction.
16 2. A resident high school student is exempt from the requirements in subparagraph b of
17 paragraph 1 of subdivision h of subsection 1 and subparagraph b of paragraph 2 of
18 subdivision h of subsection 1 for units earned during a semester, quarter, or term that
19 includes March, April, or May of 2020.
20 North Dakota career and technical education scholarship. (Effective after July 31,
21 2021)
22 1. Any resident student who graduates from a high school during or after the 2010-11
23 school year and any resident student who completes a program of home education
24 supervised in accordance with chapter 15.1-23 during or after the 2012-13 school year
25 is eligible to receive a North Dakota career and technical education scholarship
26 provided the student:
27 1. a. Completed four units of English language arts from a sequence that includes
28 literature, composition, and speech;
29 2. b. Completed three units of mathematics, including:
30 a. (1) One unit of algebra II, as defined by the superintendent of public instruction;
31 and

1 b. (2) Two units of any other mathematics, which may include one unit of
2 computer science;
3 3. c. Completed three units of science, consisting of:
4 a. (1) (a) One unit of biology;

30 of public instruction which may be governed by rules adopted by the
31 superintendent of public instruction;

1 7. g. Completed any five additional units, two of which must be in the area of career
2 and technical education;
3 8.a.h.(1)(a) Obtained a cumulative grade point average of at least 3.0 on a 4.0
4 grading scale, as determined by the superintendent of public
5 instruction, based on all high school units in which the student was
6 enrolled; and
7 (2) (b) Obtained a grade of at least "C" in each unit or one-half unit, except
8 as provided under subsection 2; or
9 b. (1)(2) (a) Obtained a cumulative grade point average of at least 3.0 on a 4.0
10 grading scale, as determined by the superintendent of public

12 7; and
13 (2) (b) Obtained a grade of at least "C" in each unit or one-half unit, except

16 a. (1) A composite score of at least twenty-four on an ACT; or
17 b. (2) A score of at least five on each of three WorkKeys assessments
18 recommended by the department of career and technical education and
19 approved by the superintendent of public instruction.
20 2. A resident high school student is exempt from the requirements in subparagraph b of

24 SECTION 2. AMENDMENT. Section 15.1-21-02.5 of the North Dakota Century Code is
25 amended and reenacted as follows:
26 15.1-21-02.5. North Dakota academic scholarship.
27 1. Any resident student who graduates from a high school during or after the 2010-11
28 school year and any resident student who completes a program of home education
29 supervised in accordance with chapter 15.1-23 during or after the 2012-13 school year
30 is eligible to receive a North Dakota academic scholarship provided the student:

1 1. a. Completed four units of English language arts from a sequence that includes
2 literature, composition, and speech;
3 2. b. Completed three units of mathematics, including:
4 a. (1) One unit of algebra II, as defined by the superintendent of public instruction;
5 b. (2) One unit of mathematics for which algebra II, as defined by the
6 superintendent of public instruction, is a prerequisite; and
7 c. (3) One unit of any other mathematics, which may include computer science;
8 3. c. Completed three units of science, consisting of:
9 a. (1) (a) One unit of biology;
10 (2) (b) One unit of chemistry; and
11 (3) (c) One unit of physics; or
12 b. (1)(2) (a) One unit of biology;
13 (2) (b) One unit of physical science; and
14 (3) (c) One unit or two one-half units of any other science;
15 4. d. Completed three units of social studies, including:
16 a. (1) One unit of United States history;
17 b. (1)(2) (a) One-half unit of United States government and one-half unit of
18 economics; or
19 (2) (b) One unit of problems of democracy; and
20 c. (3) One unit or two one-half units of any other social studies, which may include
21 civics, civilization, geography and history, multicultural studies, North Dakota
22 studies, psychology, sociology, and world history;
23 5. a.e. (1) Completed one unit of physical education; or
24 b. (2) One-half unit of physical education and one-half unit of health;
25 6. a.f. (1) Completed two units of:
26 (1) (a) The same foreign language;
27 (2) (b) The same native American language;
28 (3) (c) American sign language; or
29 (4) (d) Career and technical education from a coordinated plan of study
30 recommended by the department of career and technical education
31 and approved by the superintendent of public instruction or an

1 education pathway, approved by the superintendent of public
2 instruction. The education pathway must consist of two units in
3 teaching profession and educational methodology and at least one
4 additional unit in advanced placement or dual-credit psychology, child
5 development, peer-to-peer leadership, or child-related careers; and
6 b. (2) One unit selected from:
7 (1) (a) Foreign languages;
8 (2) (b) Native American languages;
9 (3) (c) American sign language;
10 (4) (d) Fine arts; or
11 (5) (e) Career and technical education;
12 7. g. Completed any five additional units;
13 8.a.h.(1) (a) Obtained a cumulative grade point average of at least 3.0 on a 4.0
14 grading scale, as determined by the superintendent of public
15 instruction, based on all high school units in which the student was
16 enrolled; and
17 (2) (b) Obtained a grade of at least "C" in each unit or one-half unit, except
18 as provided under subsection 2; or
19 b. (1)(2) (a) Obtained a cumulative grade point average of at least 3.0 on a 4.0
20 grading scale, as determined by the superintendent of public
21 instruction, based only on the units required by subsections 1 through
22 7; and
23 (2) (b) Obtained a grade of at least "C" in each unit or one-half unit, except
24 as provided under subsection 2;
25 9. i. Received a composite score of at least twenty-four on an ACT; and
26 10. a.j. (1) Fulfilled any one unit requirement set forth in subsections 1 through 7 by
27 means of an advanced placement course and examination;
28 b. (2) Fulfilled any one unit requirement set forth in subsections 1 through 4 or 6
29 by completion, through an early entrance program, of a nonremedial
30 postsecondary course offered for credit at an accredited institution of higher
31 education which has a physical presence in this state; or

1 c. (3) Fulfilled any one-half unit requirement set forth in subsections 1 through 7
2 by means of a dual-credit course.
3 2. A resident high school student is exempt from the requirements in subparagraph b of
4 paragraph 1 of subdivision h of subsection 1 and subparagraph b of paragraph 2 of
5 subdivision h of subsection 1 for units earned during a semester, quarter, or term that
6 includes March, April, or May of 2020.
7 SECTION 3. EMERGENCY. This Act is declared to be an emergency measure.
