1    A BILL for an Act to amend and reenact subsection 1 of section 50-06.4-10 of the North Dakota
2    Century Code, relating to membership of the brain injury advisory council; and to provide for
3    application.
4    BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
5        SECTION 1. AMENDMENT. Subsection 1 of section 50-06.4-10 of the North Dakota
6    Century Code is amended and reenacted as follows:
7        1.   The governor shall appoint at least five, but no more than nine, voting members to
8             serve on the brain injury advisory council as follows. The governor may make
9             appointments under this subsection so a majority of the total voting members
10            appointed under subsections 1 and 2 are brain injury survivors and family members of
11            brain injury survivors. The members appointed by the governor must consist of the
12            following:
13            a.     OneAt least one brain injury survivor, nominated by the council;
14            b.     OneAt least one family member of a brain injury survivor, nominated by the
15                   council;
16             c.    At least one service provider who provides services to brain injury survivors,
17                   nominated by the council, who may be a brain injury survivor or a family member
18                   of a brain injury survivor;
19            d.     An individual representing the Indian affairs commission, nominated by the Indian
20                   affairs commission, who may be a brain injury survivor or a family member of a
21                   brain injury survivor; and
22            e.     At least one individual representing a religious, charitable, fraternal, civic,
23                   educational, legal, veteran, welfare, or professional group or organization, who
24                   may be a brain injury survivor or a family member of a brain injury survivor.

1       SECTION 2. APPLICATION. The governor shall implement this Act with brain injury
2   advisory council appointments effective September 1, 2021. This Act does not require the
3   governor to increase the membership of the council.
