1 A BILL for an Act to create and enact section 62.1-02-14 and a new section to chapter 62.1-05
2 of the North Dakota Century Code, relating to a waiting period for the purchase of a firearm, a
3 ban on bump stocks, and licensure requirements; to provide for a legislative management
4 study; and to provide a penalty.
5 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
6 SECTION 1. Section 62.1-02-14 of the North Dakota Century Code is created and enacted
7 as follows:
8 62.1-02-14. Purchase and delivery of firearms - Mandatory waiting period -
9 Exception - Penalty.
10 1. Except as otherwise provided in section 62.1-02-03, a mandatory waiting period of
11 three days between the purchase and delivery of a firearm must be imposed on any
12 firearm purchased from a firearm dealer licensed under the Gun Control Act of 1968
13 [27 CFR 478.41; 18 U.S.C. 923].
14 2. Firearm dealer records of firearm sales must be available for inspection by a law
15 enforcement officer during normal business hours.
16 3. Subsection 1 does not apply to:
17 a. An individual licensed to carry a firearm or dangerous weapon concealed under
18 section 62.1-04-03;
19 b. A trade for another firearm;
20 c. An individual who possesses a valid apprentice hunter validation under section
21 20.1-03-01.5; or
22 d. A law enforcement officer.
23 4. An individual who violates this section is guilty of a class C felony.
24 5. The attorney general may adopt rules necessary to implement this section.

1 6. As used in this section, "law enforcement officer" means a public servant authorized
2 by law or by a government agency or branch to enforce the law and to conduct or
3 engage in investigations or prosecutions for violations of law.
4 SECTION 2. A new section to chapter 62.1-05 of the North Dakota Century Code is created
5 and enacted as follows:
6 Possession of bump stock - Penalty.
7 1. As used in this section, "bump stock" means a conversion kit, a tool, an accessory, or
8 a device used to alter the rate of fire of a firearm to mimic automatic weapon fire or
9 which is used to increase the rate of fire to a faster rate than is possible for a person to
10 fire a semiautomatic firearm unassisted by a kit, tool, accessory, or device.
11 2. A person may not import into the state, transfer, distribute, sell, possess, or give to
12 another person a bump stock.
13 3. A person who violates this section is guilty of a class C felony. Upon arrest of that
14 person, law enforcement shall seize the bump stock. Upon a conviction under this
15 section, law enforcement shall destroy the bump stock.
16 SECTION 3. LEGISLATIVE MANAGEMENT STUDY. During the 2019-20 interim, the
17 legislative management shall study the impact of raising the minimum age to purchase or
18 possess a firearm from eighteen to twenty-one. The legislative management shall report its
19 findings and recommendations, together with any legislation required to implement the
20 recommendations, to the sixty-seventh legislative assembly.
