2 AN ACT TO REMOVE CERTAIN DESCRIBED PROPERTY FROM THE CORPORATE
3 LIMITS OF THE TOWN OF NEWPORT.
4 The General Assembly of North Carolina enacts:
5 SECTION 1. The following described property is removed from the corporate limits
6 of the Town of Newport:
7 BEGINNING at an iron pipe on the northern right of way of N.C. Secondary Road 1127,
8 (Masontown Road), said iron pipe being the southwest corner of Lot 15 of "LAKE VIEW PARK"
9 Extended No. I, as recorded in Map Book 2 Page 151 of the Carteret County Register of Deeds,
10 said iron pipe being located N 02° 58' W 29.37 feet from a nail in the center of the
11 above-mentioned road, said nail being S 87°03' 53" W 701.63 feet from the intersection of the
12 centerlines of said road and the Atlantic and East Carolina Railroad, said nail also being S 89°
13 OS' 02" E 907.OS feet from a second nail in the center of said road, and running from said iron
14 pipe, with the northern right of way of NCSR 1127 S 87°02' W 30.00 feet to an iron pipe, said
15 iron pipe being the Southeast corner of Lot 16 of "LAKE VIEW PARK" Extended No. 1; thence,
16 with the east line of Lot 16, N 02° 58' W 200.66 feet to an iron pipe, the northeast corner of Lot
17 16, said iron pipe also being the southeast corner of Lot 16A, as shown on that map entitled
18 "Survey for DEXTER GARNER HEIRS", as recorded in Map Book 30 Page 285 of the Carteret
19 County Register of Deeds; thence, with the lines of Lot 16A, N 02 ° 58' W 199.78 feet to an iron
20 pipe; thence S 87°02' W 100.00 feet to an iron pipe; thence S 02 ° 58' W 199.77 feet to an iron
21 pipe, the southwest corner of Lot 16A, said iron pipe also being the northwest corner of Lot 16
22 of "LAKE VIEW PARK" Extended No. I, thence, with the lines of "LAKE VIEW PARK"
23 Extended No. I, as determined by existing monuments, S 87° 02' 23" W 393.66 feet to an iron
24 pipe; the northwest corner of Lot 19; thence S 23 ° 27' 45" E 213.35 feet to an iron pipe on the
25 northern right of way of NCSR 1127, said iron pipe being the southwest corner of Lot 19; thence,
26 with said right of way, N 86° 39' 31 11 W 64.65 feet to an iron pipe on said right of way, said
27 iron pipe being the southeast corner of Lot 20; thence N 24°12' 28" W 228.84 feet to an iron
28 pipe, the northeast corner of Lot 20, thence N 80° 38' 01" W 56.79 feet to an iron pipe; thence
29 N 87° 27' 57" W 99.64 feet to an iron pipe; thence N 85 ° 29' 57" W 129.40 feet to an iron pipe,
30 the northwest corner of Lot 22; thence S 01 ° 42' 36" E 201.32 feet to a point; which falls in a
31 pine tree, on the northern right of way of NCSR 1127, said point also being the southwest corner
32 of Lot 22; thence, with said right of way N 84 ° 15' W 20.88 feet to a point on said right of way,
33 said point being S 01 ° 22' 18" E 0.50 feet from an existing axle, said point also being the
34 southeast corner of the Aubrey Mason and wife Ellen B. Mason lot (now or formerly); thence,
35 with said Mason line, N 01 ° 22' 18" W 200.31 feet to an existing axle, the northeast corner of
36 said Mason lot, said axle also being a comer of the Keith Mason and wife Peggy W. Mason, and

1 Aubrey Mason and wife Ellen B. Mason Tract (now or formerly); thence, with the lines of said
2 Mason Tract, N 01 ° 22' 18" W 420.40 feet to an iron pipe; thence N 53 ° 26' 59" E 694.86 feet,
3 crossing a pond, to an iron pipe in the beginning of a ditch; thence, along said ditch (known as
4 Hill ditch) N 87°12' 15" E 123.03 feet to a point; thence N 43 ° 20' 43" E 172.66 feet to a point;
5 thence N 18 ° 35' 03" E 162.14 feet to a point; thence N 59° 44' 22" E 108.57 feet to an iron pipe
6 in said ditch; said iron pipe being S 59°44' 22" W 50.27 feet from a nail in the center of the tracks
7 of the Atlantic and East Carolina Railroad, said Railroad right of way extending 100 feet from
8 center of tracks; thence, from said iron pipe, and with a line parallel to and 50.00 feet from the
9 centerline of said railroad tracks (line according to Map Book 2, Page 151), S 24 0 16' 08" E
10 1,057.77 feet to an iron pipe, said iron pipe being the northeast corner of Lot 1 IA, as shown on
11 that map entitled "Survey for DEXTER GARNER HEIRS" (Map Book 30 Page 285); thence
12 with the northern lines of Lots 11A, 12A, 13A, 14A and 15A, S 8T 02' W 480.19 feet to an iron
13 pipe, the northwest corner of Lot 15A; thence, with the west line of Lot 15A S 02° 58' E 200.00
14 feet to an iron pipe, the southwest corner of Lot 15A, said iron pipe also being the northwest
15 corner of Lot 15 of "LAKE VIEW PARK" Extended No. 1; thence, with the west line of Lot 15,
16 S 02° 58' E 200.44 feet to the POINT OF BEGINNING.
17 SECTION 2. This act has no effect upon the validity of any liens of the Town of
18 Newport for ad valorem taxes or special assessments outstanding before the effective date of this
19 act. Such liens may be collected or foreclosed upon after the effective date of this act as though
20 the property were still within the corporate limits of the Town of Newport.
21 SECTION 3. This act becomes effective June 30, 2024. Property in the territory
22 described in Section 1 of this act as of January 1, 2024, is no longer subject to municipal taxes
23 for taxes imposed for taxable years beginning on or after July 1, 2024.
