2 AN ACT TO REALIGN THE TERMS OF OFFICE FOR CERTAIN MEMBERS OF THE
3 BOARDS OF TRUSTEES OF CERTAIN COMMUNITY COLLEGES.
4 The General Assembly of North Carolina enacts:

6 PART I. ASHEVILLE-BUNCOMBE TECHNICAL COMMUNITY COLLEGE
7 SECTION 1. Notwithstanding G.S. 115D-13, as amended by Section 6.10(o) of S.L.
8 2023-134, for the term of office of the Board of Trustees of Asheville-Buncombe Technical
9 Community College that is elected by the Madison County Board of Commissioners and expires
10 June 30, 2025, the Board shall elect one trustee to a term of one year, beginning July 1, 2025, so
11 that the term expires June 30, 2026.

13 PART II. BLUE RIDGE COMMUNITY COLLEGE
14 SECTION 2. Notwithstanding G.S. 115D-13, as amended by Section 6.10(o) of S.L.
15 2023-134, the terms of office for certain members of the Board of Trustees of Blue Ridge
16 Community College shall be revised as follows:
17 (1) Of the two terms elected by the Henderson County Board of Commissioners
18 that expire June 30, 2025, the Board shall elect one trustee to a term of three
19 years, beginning July 1, 2025, so that the term expires June 30, 2028.
20 (2) Of the two terms elected by the Henderson County Board of Education that
21 expire June 30, 2025, the General Assembly, upon the recommendation of the
22 Speaker of the House of Representatives, shall appoint one trustee to a term
23 of three years, beginning July 1, 2025, so that the term expires June 30, 2028.
24 (3) Of the two terms elected by the Henderson County Board of Commissioners
25 that expire June 30, 2027, the Board shall elect one trustee to a term of three
26 years, beginning July 1, 2027, so that the term expires June 30, 2030.
27 (4) Of the two terms elected by the Henderson County Board of Education that
28 expire June 30, 2027, the General Assembly, upon the recommendation of the
29 Speaker of the House of Representatives, shall appoint one trustee to a term
30 of three years, beginning July 1, 2027, so that the term expires June 30, 2030.

32 PART III. DAVIDSON-DAVIE COMMUNITY COLLEGE
33 SECTION 3. Notwithstanding G.S. 115D-13, as amended by Section 6.10(o) of S.L.
34 2023-134, the terms of office for certain members of the Board of Trustees of Davidson-Davie
35 Community College shall be revised as follows:

1 (1) For the one term elected by the Davidson County Board of Education that
2 expires June 30, 2024, the General Assembly, upon the recommendation of
3 the Speaker of the House of Representatives, shall appoint one trustee to a
4 term of one year, beginning July 1, 2024, so that the term expires June 30,
5 2025.
6 (2) Of the two terms elected by the Davie County Board of Commissioners that
7 expire June 30, 2026, the Board shall elect one trustee to a term of two years,
8 beginning July 1, 2026, so that the term expires June 30, 2028.

10 PART IV. SOUTHWESTERN COMMUNITY COLLEGE
11 SECTION 4. Notwithstanding G.S. 115D-13, as amended by Section 6.10(o) of S.L.
12 2023-134, the terms of office for certain members of the Board of Trustees of Southwestern
13 Community College shall be revised as follows:
14 (1) For the one term elected by the Macon County Board of Commissioners that
15 expires June 30, 2024, the Board shall appoint one trustee to a term of one
16 year, beginning July 1, 2024, so that the term expires June 30, 2025.
17 (2) Of the two terms elected by the Jackson County Board of Commissioners that
18 expire June 30, 2026, the Board shall elect one trustee to a term of one year,
19 beginning July 1, 2026, so that the term expires June 30, 2027.
20 (3) Of the two additional terms to be elected by the Swain County Board of
21 Commissioners, the Board shall elect one trustee to a term of two years,
22 beginning July 1, 2024, so that the term expires June 30, 2026.

24 PART V. TRI-COUNTY COMMUNITY COLLEGE
25 SECTION 5. Notwithstanding G.S. 115D-13, as amended by Section 6.10(o) of S.L.
26 2023-134, the terms of office for certain members of the Board of Trustees of Tri-County
27 Community College shall be revised as follows:
28 (1) For the two additional terms to be elected by the Clay County Board of
29 Commissioners, the Board shall do the following:
30 a. Elect one trustee to a term of one year, beginning July 1, 2024, so that
31 the term expires June 30, 2025.
32 b. Elect one trustee to a term of three years, beginning July 1, 2024, so
33 that the term expires June 30, 2027.
34 (2) Of the two additional terms to be elected by the Graham County Board of
35 Commissioners, the Board shall elect one trustee to a term of two years,
36 beginning July 1, 2024, so that the term expires June 30, 2026.
37 (3) For the additional term to be elected by the Cherokee County Board of
38 Commissioners, the Board shall elect one trustee to a term of three years,
39 beginning July 1, 2024, so that the term expires June 30, 2027.

41 PART VI. MISCELLANEOUS
42 SECTION 6.(a) For the boards of trustees of the community colleges addressed in
43 this act, in accordance with G.S. 115D-12, G.S. 115D-13, and Section 6.10 of S.L. 2023-134, the
44 following shall apply for any seat in which a specific term length is not provided or revised:
45 (1) For current seats, the term shall expire at the end of its previously appointed
46 or elected term.
47 (2) For additional seats to be elected or appointed pursuant to Section 6.10 of S.L.
48 2023-134, in order to maintain staggered terms, the initial term shall begin
49 July 1, 2024, and expire June 30, 2028.
50 SECTION 6.(b) The successors to the trustees elected or appointed to terms of less
51 than four years pursuant to this act shall be elected or appointed, following the expiration of those

1 terms, to terms of four years on July 1, and every four years thereafter, in accordance with
2 G.S. 115D-13, as amended by Section 6.10(o) of S.L. 2023-134.

5 SECTION 7. This act is effective when it becomes law.
