Short Title: Southern Pines/Ordinances Voting Requirements. (Local)

2 AN ACT AMENDING THE CHARTER OF THE TOWN OF SOUTHERN PINES TO
3 PROVIDE THAT A TOWN ORDINANCE MAY BE FINALLY ADOPTED ON THE
4 DATE INTRODUCED BY A SIMPLE MAJORITY.
5 The General Assembly of North Carolina enacts:
6 SECTION 1. Section 2.8 of the Charter of the Town of Southern Pines, being
7 Chapter 352 of the Session Laws of 1981, as amended by Town Ordinance No. SP05.502
8 (adopted August 12, 1989), reads as rewritten:
9 "Sec. 2.8. Voting Requirements; Quorum.– Official action of the Town Council shall, unless
10 otherwise provided by law, be by majority vote, provided that a quorum, consisting of a majority
11 of the actual membership of the Council, is present. Vacant seats are to be subtracted from the
12 normal Council membership to determine the actual membership. All final votes of the Town
13 Council involving an ordinance, resolution or the expenditure of fifty dollars ($50.00) or more
14 shall be by ayes and noes and shall be entered on the records. Three At least three affirmative
15 votes at least shall be necessary for the passage of any order, ordinance, or resolution.
16 Notwithstanding the provisions of G.S. 160A-75, an ordinance or any action having the effect of
17 an ordinance may be finally adopted on the date on which it is introduced by the affirmative vote
18 of a majority of the members of the Town Council. For the purposes of this section on Voting
19 voting requirements, the Mayor of the Town of Southern Pines shall be considered as a voting
20 member of the Council, and that should be taken into consideration in establishing the
21 requirements for a quorum."
22 SECTION 2. This act is effective when it becomes law.
