Short Title: Study Cost-of-Living Increase for ADAs/APDs. (Public)

2 AN ACT TO STUDY A COST-OF-LIVING PAY STRUCTURE FOR ASSISTANT DISTRICT
3 ATTORNEYS AND ASSISTANT PUBLIC DEFENDERS.
4 The General Assembly of North Carolina enacts:
5 SECTION 1. The Administrative Office of the Courts, in consultation with the North
6 Carolina Conference of District Attorneys and the Office of Indigent Defense Services, shall
7 study each of the following:
8 (1) The current pay structure for North Carolina assistant district attorneys and
9 assistant public defenders.
10 (2) The current pay structure for federal employees, including a base salary and a
11 cost-of-living increase based upon the cost-of-living of the area where the job
12 is located.
13 (3) The manner in which cost-of-living increases could be allotted for North
14 Carolina assistant district attorneys and assistant public defenders serving in
15 different counties throughout the State.
16 (4) The projected costs of adopting a pay structure for North Carolina assistant
17 district attorneys and assistant public defenders that would include a
18 cost-of-living increase.
19 (5) The feasibility, based upon cost projections and any other relevant
20 information, of adopting a pay structure for North Carolina assistant district
21 attorneys and assistant public defenders that would include a cost-of-living
22 increase.
23 SECTION 2. No later than April 1, 2024, the Administrative Office of the Courts,
24 in consultation with the North Carolina Conference of District Attorneys and the Office of
25 Indigent Defense Services, shall report to the Joint Legislative Oversight Committee on Justice
26 and Public Safety the results of its study, including any recommendations for proposed legislation
27 regarding the subjects studied pursuant to Section 1 of this act.
28 SECTION 3. This act is effective when it becomes law.
