3 SCHOLARSHIP STUDENTS TO ADMINISTER ONE OF THE FIVE MOST COMMON
4 NATIONALLY STANDARDIZED TESTS AND TO REQUIRE THE STATE
5 EDUCATION ASSISTANCE AUTHORITY TO MAINTAIN A LIST OF THOSE TESTS.
6 The General Assembly of North Carolina enacts:
7 SECTION 1. G.S. 115C-562.5 reads as rewritten:
8 "§ 115C-562.5. Obligations of nonpublic schools accepting eligible students receiving
9 scholarship grants.
10 (a) A nonpublic school that accepts eligible students receiving scholarship grants shall
11 comply with the following:
12 …
13 (4) Administer, at least once in each school year, a one of the five most common
14 nationally standardized test tests or other nationally standardized equivalent
15 measurement measurements selected by the chief administrative officer of the
16 nonpublic school to all eligible students whose tuition and fees are paid in
17 whole or in part with a scholarship grant enrolled in grades three and higher.
18 For grades three through eight, the nationally standardized test or other
19 equivalent measurement selected must measure achievement in the areas of
20 English grammar, reading, spelling, and mathematics. For grades nine through
21 12, the nationally standardized test or other equivalent measurement selected
22 must measure either (i) achievement in the areas of English grammar, reading,
23 spelling, and mathematics or (ii) competencies in the verbal and quantitative
24 areas. Test performance data shall be submitted to the Authority by July 15 of
25 each year. Test performance data reported to the Authority under this
26 subdivision is not a public record under Chapter 132 of the General Statutes.
27 The Authority, in consultation with the Department of Public Instruction, shall
28 maintain on its website a current list of the five most common nationally
29 standardized tests or other nationally standardized equivalent measurements
30 that meet the requirements of this subdivision and shall annually distribute
31 this information to nonpublic schools accepting eligible students receiving
32 scholarship grants under this Part.

34 SECTION 2. This act is effective when it becomes law and applies beginning with
35 the 2023-2024 school year.
