Short Title: Chiropractic Preceptorship Modifications. (Public)

3 PRECEPTORSHIP PROGRAMS TO PROVIDE CERTAIN SERVICES UNDER DIRECT
4 SUPERVISION.
5 The General Assembly of North Carolina enacts:
6 SECTION 1. G.S. 90-142.1 reads as rewritten:
7 "§ 90-142.1. Supervised training programs authorized.
8 (a) As used in this section, "preceptorship program" means a clinical program of an
9 approved chiropractic college in which a student of chiropractic, under the direct supervision of
10 a licensed chiropractor, observes the licensed chiropractor and may perform the duties of a
11 certified chiropractic clinical assistant services as specified in G.S. 90-143.4.defined in
12 G.S. 90-143(a) and subject to G.S. 90-151. For the purposes of this section, "direct supervision"
13 means that the supervising licensed chiropractor must be within the immediate patient treatment
14 area and available to the student at all times.
15 (b) Each student enrolled in a chiropractic college that meets the accreditation
16 requirements of G.S. 90-143 may participate in a preceptorship program."
17 SECTION 2. G.S. 90-147 reads as rewritten:
18 "§ 90-147. Practice without license a misdemeanor; injunctions.
19 Any person practicing chiropractic in this State without possessing a license as provided in
20 this Article shall be guilty of a Class 1 misdemeanor.misdemeanor, except that students of
21 chiropractic participating in a preceptorship program may perform chiropractic services without
22 a license under direct supervision as set forth in G.S. 90-142.1.
23 The North Carolina State Board of Chiropractic Examiners may appear in its own name in
24 the superior court in an action for injunctive relief to prevent violation of this section, and the
25 superior court shall have the power to grant such injunction regardless of whether criminal
26 prosecution has been or may be instituted. An action under this section shall be commenced in
27 the superior court district in which the respondent resides or has his principal place of business
28 or in which the alleged violation occurred."
29 SECTION 3. The North Carolina State Board of Chiropractic Examiners shall adopt
30 temporary rules to implement the provisions of this act.
31 SECTION 4. This act becomes effective October 1, 2023.
