2 AN ACT AUTHORIZING MEMBERS OF THE BOARD OF COMMISSIONERS OF
3 CABARRUS COUNTY TO PARTICIPATE IN BOARD MEETINGS BY
4 SIMULTANEOUS COMMUNICATION.
5 The General Assembly of North Carolina enacts:
6 SECTION 1. G.S. 153A-43 reads as rewritten:
7 "§ 153A-43. Quorum.
8 (a) A majority of the membership of the board of commissioners constitutes a quorum.
9 The number required for a quorum is not affected by vacancies. If a member has withdrawn from
10 a meeting without being excused by majority vote of the remaining members present, he or she
11 shall be counted as present for the purposes of determining whether a quorum is present. The
12 board may compel the attendance of an absent member by ordering the sheriff to take the member
13 into custody.
14 (b) Any member present by means of simultaneous communication in accordance with
15 G.S. 166A-19.24 communication, as that term is defined in G.S. 166A-19.24, shall be counted
16 as present for the purposes of whether a quorum is present only during the period while
17 simultaneous communication is maintained for that member. Notwithstanding the provisions of
18 G.S. 166A-19.24, no declaration of emergency shall be required for a member of the board of
19 commissioners to participate in a meeting by means of simultaneous communication; provided,
20 however, if a member participates in a meeting by simultaneous communication, the board of
21 commissioners shall comply with the requirements of G.S. 166A-19.24."
22 SECTION 2. This act applies only to Cabarrus County.
23 SECTION 3. This act is effective when it becomes law and applies to meetings held
24 on or after that date.
