3 COUNTY BOARD OF EDUCATION AND TO ALIGN THE DISTRICTS OF NASH
4 COUNTY BOARD OF EDUCATION MEMBERS WITH THE DISTRICTS OF NASH
5 COUNTY COMMISSIONERS.
6 The General Assembly of North Carolina enacts:
7 SECTION 1. Sections 9, 10, and 11 of Chapter 391 of the 1991 Session Laws are
8 repealed.
9 SECTION 2. Subdivision (3) of Section 7 of S.L. 2016-14 is repealed.
10 SECTION 3. Beginning in 2024, the Nash County Board of Education shall consist
11 of seven members elected for four-year terms of office on a nonpartisan basis as provided in
12 Chapter 115C and Chapter 163 of the General Statutes, with the results determined in accordance
13 with G.S. 163-292. The filing period shall be from noon on the first Friday in July until noon on
14 the first Friday in August. One member shall be elected from each district used to elect county
15 commissioners. Persons elected to the Nash County Board of Education shall take office on the
16 second Monday in December following their election, and the terms of their office shall date and
17 extend from that time. No person shall be eligible to file for, or be elected to, the Nash County
18 Board of Education, or to serve on the Nash County Board of Education, unless the person is a
19 qualified voter and resident of the district from which the person seeks to be elected. Candidates
20 shall be voted on by the electors residing in the district from which they seek election. All
21 members of the Nash County Board of Education shall be elected in 2024. In order to implement
22 staggered terms, for elections held in 2024, members from Districts 1, 3, 5, and 7 shall be elected
23 to four-year terms and members from Districts 2, 4, and 6 shall be elected to a two-year term and
24 to four-year terms thereafter.
25 SECTION 4. Notwithstanding Section 3 of this act, all members residing in Nash
26 County who were elected to the Nash-Rocky Mount Board of Education in 2022 shall continue
27 to hold at-large positions on the Board until the end of their term or a vacancy occurs due to
28 resignation or other causes.
29 SECTION 5. This act is effective when it becomes law and applies to elections held
30 beginning in 2024.
