Short Title: Property Owners Protection Act. (Public)

5 The General Assembly of North Carolina enacts:
6 SECTION 1. G.S. 14-159.12(a) reads as rewritten:
7 "(a) Offense. – A person commits the offense of first degree trespass if, without
8 authorization, he enters or remains:the person does any of the following:
9 (1) On Enters or remains on the premises of another so enclosed or secured as to
10 demonstrate clearly an intent to keep out intruders;intruders.
11 (2) In Enters or remains in a building of another; oranother.
12 (3) On Enters or remains on the lands of the Eastern Band of Cherokee Indians
13 after the person has been excluded by a resolution passed by the Eastern Band
14 of Cherokee Indian Tribal Council.
15 (4) Enters or remains on the premises of another between the hours of midnight
16 and 6:00 A.M."
17 SECTION 2. This act becomes effective December 1, 2023, and applies to offenses
18 committed on or after that date.
