2 AN ACT TO PROVIDE THAT, BEGINNING IN 2024, MEMBERS FOR THE WAKE
3 COUNTY BOARD OF COMMISSIONERS SHALL BE ELECTED FROM ELECTORAL
4 DISTRICTS ON A NONPARTISAN PLURALITY BASIS.
5 The General Assembly of North Carolina enacts:
6 SECTION 1. Section 2 of Chapter 983 of the 1981 Session Laws reads as rewritten:
7 "Sec. 2. Wake County is divided into seven residence districts for elections to the Wake
8 County Board of Commissioners. In accordance with Option D, G.S. 153A-58(3)d., the members
9 shall reside in and represent the districts according to the apportionment plan adopted in this act,
10 but the qualified voters of the entire county shall nominate all candidates for and elect all
11 members of the board.The districts shall be the districts as were adopted by the Wake County
12 Board of Commissioners on November 1, 2021. Each member of the Wake County Board of
13 Commissioners shall be elected to represent one single-member district. The qualified voters of
14 each district shall nominate candidates and elect members who reside in the district for the seat
15 apportioned to that district."
16 SECTION 2. Section 5 of Chapter 983 of the 1981 Session Laws reads as rewritten:
17 "Sec. 5. Election to the Wake County Board of Commissioners shall be on a partisan basis,
18 and nonpartisan basis at the time of the general election for county officers in even-numbered
19 years, and the results shall be determined by using the nonpartisan plurality method as provided
20 in G.S. 163-292. Candidates seeking office shall file their notices of candidacy with the board of
21 elections no earlier than 12:00 noon on the first Friday in July and no later than 12:00 noon on
22 the third Friday in July preceding the election. Except as otherwise provided by this act, elections
23 shall be conducted in accordance with Chapter 163 of the General Statutes. Vacancies shall be
24 filled in accordance with law."
25 SECTION 3. In 2024, and every four years thereafter, the candidates elected from
26 Districts 4, 5, and 6 shall each serve a four-year term. In 2026, and every four years thereafter,
27 the candidates elected from Districts 1, 2, 3, and 7 shall each serve a four-year term.
28 SECTION 4.(a) Sections 3 and 4 of Chapter 983 of the 1981 Session Laws are
29 repealed.
30 SECTION 4.(b) S.L. 2015-4 is repealed.
31 SECTION 5. This act is effective when it becomes law and applies to elections held
32 on or after that date.
