2 AN ACT TO REGULATE HUNTING WITH ARTIFICIAL LIGHT IN MACON AND CLAY
3 COUNTIES.
4 The General Assembly of North Carolina enacts:
5 SECTION 1. Notwithstanding any other provision of law, it is unlawful for any
6 person to shine a light intentionally upon any wild animal, including, but not limited to, deer,
7 coyotes, or feral swine, from the right-of-way of any public road, street, or highway between the
8 hours of one-half hour after sunset and one-half hour before sunrise.
9 SECTION 2. Section 1 of this act does not apply to the necessary shining of lights
10 by motorists engaged in normal travel on the highway or to landowners, campers, or others who
11 are not attempting to attract or immobilize wildlife by the use of lights.
12 SECTION 3. Violation of this act is a Class 2 misdemeanor.
13 SECTION 4. This act is enforceable by law enforcement officers of the Wildlife
14 Resources Commission, by sheriffs and deputy sheriffs, and by other law enforcement officers
15 with general subject matter jurisdiction.
16 SECTION 5. This act applies only to Macon and Clay Counties.
17 SECTION 6. This act becomes effective October 1, 2019, and applies to offenses
18 committed on or after that date.
