2 AN ACT TO CLARIFY THAT A LOCAL DECLARATION OF EMERGENCY INCLUDES
3 THE AUTHORITY TO CLOSE ROADS AND PUBLIC VEHICULAR AREAS TO THE
4 PUBLIC DURING THE EMERGENCY.
5 The General Assembly of North Carolina enacts:
6 SECTION 1. G.S. 166A-19.31(b)(1) reads as rewritten:
7 "(1) Of movements of people in public places, including any of the following:
8 a. imposing Imposing a curfew;curfew.
9 b. directing Directing and compelling the voluntary or mandatory
10 evacuation of all or part of the population from any stricken or
11 threatened area within the governing body's jurisdiction;jurisdiction.
12 c. prescribing Prescribing routes, modes of transportation, and
13 destinations in connection with evacuation;evacuation.
14 d. and controlling Controlling ingress and egress of an emergency area,
15 and the movement of persons within the area.that area.
16 e. Providing for the closure of roads and public vehicular areas of an
17 emergency area, except to the movement of emergency responders and
18 other persons necessary for recovery from the emergency. In addition
19 to any other notice or dissemination of information, notification of any
20 closure of a road or public vehicular area under the authority of this
21 sub-subdivision shall be given to the Department of Transportation as
22 soon as practicable."
23 SECTION 2. This act is effective when it becomes law.
