The bill authorizes the Governor of Montana to enter into agreements with tribal governments to facilitate the regulation of marijuana, aiming to enhance cooperation between state and tribal jurisdictions. These agreements can cover a wide range of topics, including law enforcement, regulatory issues concerning the production and sale of marijuana, medical research, taxation, and dispute resolution. The agreements must also address public health and safety, security of facilities, and cross-border commerce in marijuana. Additionally, the bill allows for tax exemptions on marijuana sales to tribes and tribal entities under certain conditions.
An appropriation of $1,000 from the general fund is designated for the office of Indian affairs to support the implementation of these agreements, effective July 1, 2025. The Secretary of State is tasked with notifying each federally recognized tribal government in Montana about the new legislation. The bill is intended to be codified as part of Title 18, chapter 11 of the Montana Code.
