This bill amends Section 46-5-227 of the Montana Code Annotated to revise the procedures for the service and return of search warrants. The key change requires that a search warrant must be exhibited not only at the location to be searched but also specifically to a known lawful occupant of the property. The previous language, which allowed for the warrant to be shown to the person to be searched or simply at the location, has been deleted.

Additionally, the bill clarifies that the officer executing the search warrant must provide a copy of the warrant and a receipt for any property taken to the person from whom the property is seized or leave these documents at the location. The bill emphasizes that failure to leave a copy and receipt does not affect the admissibility of the seized property in court. This act is set to take effect immediately upon passage and approval.
