The bill prohibits overnight camping and the storage of personal property on state highway right-of-ways in Montana. It defines key terms such as "camping," "campsite," "overnight camping," "state highway right-of-way," and "storage." The prohibition does not apply in emergency situations, to authorized work crews, or in designated rest areas where temporary parking is allowed for up to 24 hours. Enforcement will be carried out by the department and law enforcement, with penalties including a written notice to vacate and a civil fine of up to $50 for non-compliance. Additionally, unattended personal property may be disposed of after a notice period of 120 hours.

The bill also grants rulemaking authority to the department to implement regulations regarding camping and personal property storage on state highway right-of-ways, including provisions for recovering fines and cleanup costs. An appropriation of $15,000 is allocated from the highway restricted account to the department of transportation for the implementation of these provisions, effective July 1, 2025. The act is intended to be codified as a new part in Title 60, chapter 6, and will take effect upon passage and approval, with the exception of the appropriation section.
