Senate Bill No. introduced by G. Hertz establishes new labeling requirements for pasteurized milk sold to consumers in Montana. The bill mandates that processors of grade A milk must include a "best by" date on each container, indicating the freshness and safety of the product. This date, which can also be referred to as a "use by" date, must be displayed in Arabic numerals or standard abbreviations, with labels contrasting in color from the surrounding area. Additionally, the bill specifies the placement and size of the labels, and it allows for the seizure and destruction of milk that does not comply with these labeling requirements. Importantly, the Department of Livestock is prohibited from adopting any new rules related to the implementation of this section.

The bill also requires the Department of Livestock to amend existing administrative rules by eliminating the definition of a "sell by" date and repealing several other related rules (ARM 32.8.202, 32.8.203, 32.8.204, 32.8.205, and 32.8.206). The provisions of this act are intended to be codified as part of Title 81, chapter 21, and the act will take effect immediately upon passage and approval.
