4 A BILL FOR AN ACT ENTITLED: “AN ACT ***; AMENDING SECTIONS 1-1-401, 1-1-402, 5-12-101, 7-14-
5 4629, AND 7-14-4630, MCA; REPEALING SECTIONS 1-1-405 AND 1-1-411, MCA; PROVIDING AN
6 APPLICABILITY DATE.”

8 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

10 NEW SECTION. Section 1. Fun. This is a great exercise.

12 NEW SECTION. Section 2. Conflict. [Section 1]

14 Section 3.Section 1. Section 1-1-401, MCA, is amended to read:
15 "1-1-401. People defined. The people, as a political body, consist of:
16 (1) electors;
17 (2) citizens not electors."

19 Section 4.Section 2. Section 1-1-402, MCA, is amended to read:
20 "1-1-402. Citizens defined. The citizens of the state are:
21 (1) all persons born in this state and residing within it, except the children of transient aliens;
22 (2) all persons born out of this state who are citizens of the United States and residing within this
23 state."

25 Section 5. Section 5-12-101, MCA, is amended to read:
26 "5-12-101. Title and purpose of chapter. (1) This chapter may be cited as "The Legislative Finance
27 and Data Analytics Act".
28 (2) Because the legislature is responsible for appropriating public funds, it shall provide for fiscal

1 analysis of state government to accumulate, compile, analyze, and furnish information on the financial matters
2 of the state that is relevant to issues of policy and questions of statewide importance.
3 (3) Because the legislature is responsible for providing a comprehensive system of efficient
4 governance, policy, and appropriations for the state and its political subdivisions, including local governments
5 and schools, analysis of data across all aspects of government revenues, services, and funding is essential.
6 (4) Because the laws enacted by the legislature remain unless later changed by the legislature,
7 appropriations may impact future generations, and tax and other law changes may impact the state's economy,
8 the legislature needs a data tool to evaluate the impacts of legislation on future generations. The tool should be
9 derived from reliable data sets and numeric in nature to allow the legislature to evaluate different assumptions
10 and potential changes in law 20 years into the future."

12 Section 6. Section 7-14-4629, MCA, is amended to read:
13 "7-14-4629. Manner of operating parking facility. (1) The commission or city may lease any project
14 acquired by it under the provisions of this part to the highest responsible bidder after notice.
15 (2) If the commission or city shall, by resolution entered upon its minutes, find and determine that
16 the purposes of this part will not be accomplished and the public interest will not be served by lease of any
17 particular project for operation as a private parking project, the commission may lease such project to the city or
18 the city may operate any such project itself as a municipal parking project, subject to the ordinances and rules
19 of the city pertaining to municipal parking projects."

21 Section 7.Section 6. Section 7-14-4630, MCA, is amended to read:
22 "7-14-4630. Notice for bids to lease parking facility. (1) The notice required by 7-14-4629(1) shall
23 consist of the publication of a notice as provided in 7-1-2121 inviting bids.
24 (2) Such notice shall distinctly and specifically describe the project and the facilities in connection
25 therewith which are to be leased, the period of time for which said project is to be leased, and the minimum
26 rental to be paid under such lease."

28 NEW SECTION. SECTION 8.SECTION 5. {standard} Repealer. The following sections of the

1 Montana Code Annotated are repealed:
2 1-1-405. Persons not citizens.
3 1-1-411. Certain state services denied to illegal aliens.

5 NEW SECTION. Section 9.Section 5. Codification instruction. [Sections 1 through 4] are intended
6 to be codified as an integral part of Title 1, chapter 1, part 4, and the provisions of Title 1, chapter 1, part 4,
7 apply to [sections 1 through 4].

9 NEW SECTION. Section 10.Section 6. {standard} Notification to tribal governments. The
10 secretary of state shall send a copy of [this act] to each federally recognized tribal government in Montana.

12 NEW SECTION. Section 11.Section 5. Applicability. [This act] applies to fill this in.
