5 A BILL FOR AN ACT ENTITLED: “AN ACT REVISING THE NONFOSSIL ENERGY GENERATION
6 PROPERTY TAX EXEMPTION FILING REQUIREMENTS; CLARIFYING THE AMOUNT OF THE
7 EXEMPTION; AMENDING SECTION 15-6-224, MCA; AND PROVIDING AN IMMEDIATE EFFECTIVE DATE.”

9 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

11 Section 1. Section 15-6-224, MCA, is amended to read:
12 "15-6-224. Nonfossil energy generation -- manner of claiming -- limitations. (1)The Subject to the
13 provisions of this section, the following portions of the appraised value of a capital investment in a recognized
14 nonfossil form of energy generation or low-emission wood or biomass combustion devices, as defined in 15-32-
15 102, are exempt from taxation for a period of 10 years following installation of the property:
16 (1)(a) $20,000 in the case of a single-family residential dwelling;
17 (2)(b) $100,000 in the case of a multifamily residential dwelling or a nonresidential structure.
18 (2) In order to receive the exemption provided by this section, an owner of property described in
19 subsection (1)(a) or (1)(b) shall submit a claim on a form prescribed by the department that must contain:
20 (a) the date of the installation of the recognized nonfossil form of energy generation or low-
21 emission wood or biomass combustion devices;
22 (b) the total cost of the installation;
23 (c) the geocode of the property where the installation occurred; and
24 (d) any other information required by the department that is relevant to the claimant's eligibility.
25 (3) The exemption amount is equal to the value of the capital investments reported to the
26 department, not to exceed the maximum allowance provided in subsection (1)."

28 NEW SECTION. Section 2. {standard} Effective date. [This act] is effective on passage and
