  4    A BILL FOR AN ACT ENTITLED: “AN ACT ***; PROVIDING DEFINITIONS.”

  6    BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

  8            NEW SECTION. Section 1.         Use of digitally altered media in elections. (1)      A campaign
  9    communication that includes any form of synthetic media must include a disclosure stating that the image,
 10    audio recording or video recording has been manipulated.

 18            NEW SECTION. Section 2.         Definitions. (1)    As used in section, the following definitions apply:
 19            (a) "Campaign communication" means a communication , regardless of the format of the
 20    communication or the medium through which the communication is disseminated, that:
 21            (i)      advocates for the election or defeat of a clearly identified candidate by:
 22            (A)      attempting to influence the outcome of an election; or
 23            (B)      attempting to injure a candidate in an election; or
 24            (ii)     solicits a contribution. (def from IN)
 25            (b) "Candidate" has the meaning provided in 13-1-101(8).
 26            (c) "Synthetic media" means an image, audio recording or video recording of an individual's
 27    appearance, speech or conduct that has been intentionally manipulated with the use of artificial intelligence
 28    techniques or other digital technology in a manner to create a realistic but false image, audio recording, or

  1    video recording that produces:
  2            (i)      a depiction that a reasonable person would believe is or a real individual in appearance,
  3    speech or conduct but that did not actually occur in reality; and
  4            (ii)     a materially different understanding or impression than a reasonable person would have from
  5    the unaltered, original version of the image, audio recording or video recording.
